A Study on Three-Dimension Land Boundary Range Establishment and Public Announcement Method

국문 초록

본 연구는 토지이용이 고도화ㆍ입체화됨에 따라 더욱 요구되어지는 3차원 토지경계의 공간적 범위를 설정하고, 이를 토대로 효율적인 공시방법을 제시하는 것이었다. 연구 결과, 3차원 토지경계는 입체적 토지경계로써, 지표뿐만 아니라, 지상과 지하공간까지를 모두 포함하는 토지경계로 볼 수 있었다. 먼저, 지상경계의 범위를 설정하기 위해서는 기존의 지표에 대한 토지등록 형태에서 벗어나, 지적측량을 실시하여 그 측량결과를 공적장부에 입체적으로 등록할 수 있는 시스템이 필요하였다. 지하경계의 범위를 설정하기 위해서는 지표와 지하공간 사이에 대한 높이값(층간 간격)이 고려된 지적측량과 지하공간에 설정되어 있는 각종 권리관계의 면밀한 조사ㆍ분석이 요구되었다. 따라서 지하공간과 지상공간에 대해 경계를 정확히 구획하고, 이에 대한 정보를 효율적으로 공시하기 위해서는 지하와 지상공간의 이용 등에 관한 각종 규정을 담고 있는 해당 법률관계의 검토가 필요하였다. 또한, 구체적이고 명확한 범위 설정 기준이 요구되었으며, 정확한 도형정보와 속성정보의 입력작업이 수반되어야 할 것으로 나타났다. 특히, 일 필지에 대한 각종 등록사항을 규율하는 근거법인 지적법의 개정 작업 내지는 별도의 특별법을 제정(가칭 “입체적 공간정보에 관한 법률”)하여 입체적으로 토지경계를 등록할 수 있는 효율적인 방안이 강구되어져야 할 것으로 나타났다.

영문 초록

The purpose of this study is to establish the spatial range of three-dimensional land boundary which is increasingly demanded as land use evolves toward ever increasing heights and cubic dimension, and to propose efficient public announcement methods on such basis. The research result has shown that three-dimensional land boundary, as a cubic land boundary, may be viewed as land boundary that includes not only ground surface but also above ground and basement space. First off, to establish ground boundary range, there needs be system that can register the result of cadastral measurement in public record book cubically by performing measurement of cadastral information beyond the existing land registration of ground surface. Establishment of underground boundary range required cadastral measurement which considered the values of height(gap between floors) between ground surface and underground space detailed survey and analysis of various rights issues established on underground space. Therefore, to accurately map out the boundary of underground space and above ground space and to efficiently publicly announce such information, it was necessary to review applicable legal matters that contain various provisions on the use of underground and above ground space etc. Also, specific and clarified range establishment criteria were required, and input work of accurate graphic information and attributes information was shown necessary to follow. In particular, it was shown required to pursue efficient programs to cubically register land boundary by revising Cadastral Act; the base law stipulating various registration issues on one single parcel, or by establishing separate special law(hereinafter referred to as “Act on cubic Space Information”).
