국문 초록

본 연구의 목적은 중국 지적제도의 실태를 조사ㆍ분석하고, 이를 토대로 중국 지적제도의 특성을 제시하는 것이었다. 연구대상을 중국의 지적제도로 한정하였고, 시간적 범위는 1986년부터 현재까지로, 공간적으로는 중국으로, 내용적으로는 중국 지적제도의 특성을 제시하는 것으로 한정하였다. 연구 결과, 중국의 지적제도는 법적ㆍ행정적 측면에서 다음과 같은 특성을 지니고 있음을 확인하였다. 중국의 지적관련 법률 대부분은 공법적 성격을 지니고 있었으며, 그 중 지적에 관한 일반법이라 할 수 있는 토지관리법을 토대로 여러 개별법이 운용되고 있었다. 중국의 지적행정은 일원화된 행정조직을 바탕으로 지적과 등기, 지가, 토지이용규제업무를 수행하고 있었으며, 지적행정의 주무부서는 국무원 산하 조직인 국토자원부 지적관리사에서 지적행정업무 전반을 담당하고 있었다. 지적측량업무와 관련하여 지적측량의 검사ㆍ관리기관은 국토자원부 국가측회국으로 지적측량뿐만 아니라, 일반측량, 토목측량 및 지형도관리 등 다양한 업무를 관장하고 있었으며, 측량업체 대부분은 국영기업이었다. 끝으로, 이러한 중국의 지적제도를 지원하는 지적학계의 특성으로는 대부분의 지적관련 학문분야에서 기초이론분야에 대한 연구에 비중을 두기 보다는 상대적으로 응용이론분야에 대한 연구가 주를 이루고 있는 것으로 나타났다.

영문 초록

The purpose of this study was to present the characteristic by researching and analysing the actual condition of the China cadastral system. For this, the object of study was limited into the China cadastral system. We established the range of time from 1986 up to now. And also the spatial range was restricted within China. As the result of study, we could recognize that the system has had various characteristic from the legal and administrative aspects. First, the cadastral law system has been particularly controled by the Land Management Law. Most of them were public laws. Second, the administration of China has been operated through the a coordinated organization. The cadastral management department in one of MLR's functional departments, and it is responsible for nationwide cadastral administration. There were four divisions in the department: Land Registration Division, Land Tenure Division, Land administration authorities at provincial, municipal, and county levels set up cadastral management functional branches such as Cadastral Division and etc. These divisions were in charge of cadastral management within their corresponding jurisdictions according to the law. The State shall establish a land survey system. Land administration departments of the People's governments at or above the country level shall, together with the departments concerned at the same level, conduct land survey. Land survey is to investigate land tenure, land use types, areas, quality, natural and socio-economical conditions.
