정보사회에서 국가의 역할에 관한 試論的考察

국문 초록

오늘날 정보통신기술의 급속한 발전은 인간 생활의 모든 영역에 걸쳐 광범위한 변화를 야기하고 있으며, 인터넷을 매개로 진행되는 세계화와 맞물려 국가의 위상과 역할에 대해 재검토해야 할 계기들이 주어지고 있다. 역사적으로 국가는 소극적인 역할의 수행을 이상으로 하던 근대국가에서 보다 적극적인 역할을 수행하는 사회국가로 그 모습을 바꾸어 왔다. 이러한 상황에서 현재는 다원성과 의사소통의 자유를 핵심으로 하는 인터넷의 발달과 이에 따른 세계화가 더해짐으로써 영토를 기반으로 하는 국가의 전통적인 기능이 위협받고 있다. 또한 정보통신기술의 발달에 힘입어 사회가 매우 복잡한 체계로 분화됨에 따라 국가는 그 과제에 있어서 질적, 양적인 변화를 경험하고 있으며, 명령과 강제보다는 다양하고 유연한 규제의 수단들이 고려되고 있다. 정보사회가 자유의 이념을 실현하며 지속적으로 발전할 수 있도록 하기 위해서는 헌법조화적 정보사회의 구축이라는 목표를 설정하고 국가와 사회의 현실을 철저히 분석해야 하며, 이를 바탕으로 국가의 새로운 위상을 정립하고 역할을 설정해야 한다. 국가는 비록 권위주의적인 태도가 약화되더라도 다양한 이해관계의 조율과 일정한 질서의 형성 및 유지를 담보할 수 있는 주체로서 계속적으로 기능해야 하며, 민간의 자율적인 동력이 발 휘될 수 있는 기반을 마련하고 이를 활용하는 기능을 수행해야 한다. 즉, 정보사회에서 새로운 국가의 역할은 공공과 민간의 협력을 가능하게 하는 형태로 설정되어야 하며 이에 적합한 규범구조가 구축되어야 한다.

영문 초록

These days along with the development of telecommunication technology the society has become very complicated. Sudden changes arise from globalization and informatization make many people raise questions whether a State can play an independent role in an information society. Facing innovative development of technologies and an unavoidable Information Society, it is necessary to have deep reconsideration on what kind of role a State has to play. First, this essay examines the changes of States’ roles and laws in history. From a historical perspective States change the point from passive Modern State to active Social State. Next, this study includes the analysis what kind of changing situations States and laws face in an information society. Analysis on central challenge of States and current situations of laws shows that States are faced with change of charge and the way of regulation as well. Especially, States consider various methods for regulation and make use of soft ways rather than drastic measures. It is necessary to establish a principle that the Information Society should develop on the basis of Constitution. Also, we have to analyze thoroughly the situation of a State and Society. With this analysis we can institute new status and roles of a State. A State is required to regulate in flexible and specialized way while respecting social autonomy and it is required to consider correlation with changing roles of a State. In this regard, this essay insists that a State should admit that it can't do all public tasks independently and it should utilize social autonomy actively.
