일본 국립대학 법인화 전후 총장선출제도의 변화와 특징

국문 초록

본 연구는 일본의 국립대학법인화 성립과정에서 나타난 총장선출제도의 변화 및 특징을 고찰하여, 한국의 총장선출제도에 시사하는 바를 알아보는데 목적이 있다. 이를 위하여 법인화 전후의 관련법령과 개별 대학의 총장선출규정을 분석하고 총장 선출과정에 참여하는 학내외 인사나 대학내부조직에 있어 권한의 이동(移動)을 조명 하였다. 분석결과, 일본 국립대학의 총장선출제도는 명확하지 않은 법제 아래에서 직원과 학생의 참여를 제한하면서 교원 중심의 총장선출 관행으로 구조화되었으나, 법인화 과정에서 이를 개혁하고자 하였다. 법인화 이전에는 교원의 투표로 총장을 선출하는 투표중심형 선출방식을 채택하였으나, 법인화 이후 학내외 인사로 구성되는 총장선 출회의가 실질적 권한을 행사하는 선출회의형으로 급격히 변화되었다. 최근 문부과학성은 대학구성원의 투표결과가 존중되어야 한다는 입장이므로 법인화 이전의 총장선출방식으로 회귀될 가능성도 있어 향후 제도운영 방향이 주목된다. 특히, 투표중심형과 선출회의형의 대립, 내부자 지배구조와 정부통제 제도의 충돌, 자교출신 총장의 지속적인 증가 등 법인화의 한계를 노정하고 있다. 일본의 국립대학 총장선출제도는 한국의 국립대학 거버넌스나 총장선출제도의 개혁방향에 비추어 보면서 보다 체계적으로 연구할 필요가 있다.

영문 초록

This study is aimed to invent implications to Korean environment through the transformation and characteristics on presidential election system followed by the incorporation of National University in Japan. The related law and regulations regarding the incorporation of National University and presidential election system was reviewed based on the literature analysis with the boundary of participation and authority within National University. The research analysis said that the National University had restriction for only faculty member to participate the presidential election system except that of staffs and students. After incorporation of the National University the restriction was changed for staffs and students to take part in the presidential election system whose transformation is called by the change from poll-oriented type to election council-oriented type. However the process of the presidential election system has controversial issues because the regulation is not articulated as well as there is pros and cons. Government of Japan is taking into consideration the former type poll-oriented type rather than election council-oriented type in order to select the efficient and effective method of the presidential election system. The presidential election system of the National University of Japan incorporation has characteristics of the increase of the number of candidate graduated from the corresponding National University the controversial issues out of poll-oriented type and election council-oriented type governance structure of insiders and government’s control to the university. It is necessary to do gradually research deeply the issues with comparative analysis of Korean cases.
