국문 초록

이 논문의 제목은 재산권의 강제적 귀속과 관련한 민사법적 고찰이라고 정하였다. 재산권 제도의 입법과정에서 당해 제도를 어떠한 모습으로 재편할 것인지,그러한 재편과정에서 어떠한 점들이 고려되어야 하는지를 논리적으로 검증하는것은 중요한 의미가 있다. 물론 장래에 어떠한 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측할 수는 없다. 그러나 그것이 사회질서를 규율하는 재산권 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수있는 방법이 모색되어야 한다. 특히 재산권 제도는 새롭게 창출되는 제도가 아니고, 인류의 역사와 함께 발전되어 온 제도라는 점에서 종래에 발생한 문제점들을 면밀하게 파악한다면, 장래에 정립될 제도는 보다 합리적이고 실질적 정의에 합치될 수 있다. 그런데 재산권 제도를 합리적으로 정립하기 위해서는 과거의 재산권이 어떠한 과정을 통하여 현재의 모습으로 형성되었는지를 검토할 필요성이 있다. 이와 관련하여 최근에 일제강점기 반민족행위자의 재산귀속에 관한 특별법이 국회를 통과하였고, 이 법률에 근거하여 국가기관이 구성되었다. 당해 국가기관은 일제강점기의 반민족행위자의 재산을 조사하고, 만약 부당하게 소유권을 취득한 것으로 판명되면 국가로 귀속시키고 있다. 물론 재산권의 강제적 귀속에 대하여 이의가 있는 이해관계인은 행정심판이나 소송을 제기할 수 있다. 그런데 현행 헌법상의 재산권 규정을 반민족행위자의 재산권 귀속이라는 상황에 그대로 대입하여 논의할 필요는 없을 것으로 생각된다. 이러한 점을 고려하여 이 논문에서 저자는 반민족행위자의 재산권의 강제적귀속과 관련한 주요한 내용을 검토하면서, 특히 재산권의 강제적 귀속과 관련하여 재산권의 귀속과정, 토지사정, 거래안전과 관련한 문제점과 그 개선방향을 검토하였다.

영문 초록

The title of this thesis is “A Study of Private Law in connection with Compulsory Reversion of Property Rights.” It would be meaningful to logically verify how to reorganize the property rights system and what aspects to consider for the reorganization in the legislation process of property rights system in the future. Of course, it would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Since property rights system is not something that is being newly developed but is a system which has evolved along with the history of mankind, a thorough examination of past problems can lead to a future legal system that is more rational and accords with substantial justice. Therefore, to rationally reorganize the property rights system for Korea, it is necessary to evaluate how this system has changed through the years. Particularly, the modernization process of property rights system would have a significant relationship with the reorganization of the system for Korea. To reorganize the property rights system for Korea, it is necessary to examine the historical development process of the past system. The Special Law about the Property Reversion of Anti National Citizens under the Japanese colonial rule lately was passed in the National Assembly on December 29, 2005. The apparatus of the nation were composed by the law. The government body is going to investigate the properties of anti-national citizens under the Japanese colonial rule. And if it is proven that ownership was acquired unfairly, it will be take them back to the State. Of course, somebody who has a complaint, may file an administrative lawsuit. Thus, there is no reason to apply property rules of Korea, which is regulated by the Constitution, directly in the changing situations of the Compulsory Reversion of Property Rights of Pro-Japanese Anti-National Citizens. The auther discussed the main contents of the Compulsory Reversion of Property Rights of Pro-Japanese Anti-National Citizens in Korea and dealt with the important contents of the Compulsory Reversion of Property Rights, and suggested especially the problems and improvements in connection with the Reversion Process of Property Rights, Assessment of Land and Safety of Transactions in connection with the Compulsory Reversion of Property Rights of Pro-Japanese Anti-National Citizens in Korea.
