국문 초록

중국 정부의 개혁 정책에 힘입어 외상투자기업의 중국 진출은 활기를 띄었으며, 중국은 빠르게 시장경제로 전환할 수 있었다. 하지만 시장경제의 발전으로 수많은 제품이 쏟아져 나오면서 제조물의 결함으로 인한 소비자의 피해는 오히 려 증가하였다. 하지만 이러한 소비자 피해에 대한 적절한 구제장치가 없다는 사회적 비판이 높아지게 되자 제품품질에 대한 감독을 강화하고, 그에 대한 책임을 명확히 하여 소비자의 합법적인 권리를 보호하기 위함을 목적으로 하는 ｢제품품 질법(产品质量法)｣이 1993년 제7기 전국인민대표대회 상무위원회 제30차 회의를통과하였다. 중국의 ｢제품품질법｣에서는 “제품 품질 책임(产品质量责任)”이라는개념을 처음으로 법률 규정에 도입하였다. 특히 제품 품질 책임으로 인한 민사상 의 손해배상책임 뿐 아니라 제품품질 감독 기관의 행정책임 및 형사책임을 함께 규정한 것은 중국 ｢제품품질법｣의 특징 중 하나이다. 본 논문에서는 중국 특색의 법률체계를 토대로 하여 최근의 법률 변화를 반영한 중국 제조물책임법의 전반적인 내용을 고찰하였다. 이러한 연구를 바탕으로 중국에 진출한 외상투자기업의 중국 제조물책임법에 대한 이해를 높이고 제조물 책임과 관련한 피해를 사전에 예방하고 적절한 사후대책을 수립하여 개별 사안에 효과적으로 대응 할 수 있도록 하는 데 목적을 두고 있다.

영문 초록

With the backing of the Chinese government’s reform policy, the number of foreign invested enterprises advancing into China has increased and China has been able to quickly convert to a market economy. Instead, however, as countless number of products poured out due to the growth of the market economy, consumer damages have increased due to defective products. With the rising social criticism about the lack of appropriate mechanisms to remedy consumer damages, the ｢Product Quality Law｣, which aims to strengthen supervision of product quality and protect legal rights of consumers by clarifying and liabilities in relation to product quality, was adopted by the 30th Session of the Standing Committee of the Seventh National People’s Congress in 1993. The concept of “liability concerning product quality” was first introduced as law in the ｢Product Quality Law｣. In particular, one of the main features of the ｢Product Quality Law｣ is that it regulates both the compensation for civil damages resulting from liability concerning product quality and the administrative and criminal liability of state functionaries engaged in the supervision and control of product quality. This paper examines the overall provisions of the Products Liability Law of China which reflects recent changes in the legal arena based on the distinct legal system of China. Based on such research, the purpose of this paper is to increase the understanding of foreign invested enterprises doing business in China regarding the Products Liability Law of China, prevent in advance any damages relating to products liability and effectively respond to individual issues by establishing appropriate countermeasures.
