방송법 상의 데이터방송 쟁점에 대한 연구

국문 초록

데이터방송은 방송과 통신의 융합 서비스적인 성격을 가지고 있는 새로운 서비스이다. 2003년 5월 이후 한국에서 데이터방송이 시작되었으나, 지금까지 방송법으로 수용되지 못하여 법적인 공백상태가 되었다가, 2004년 3월 방송법이 개정됨으로써 비로소 데이터방송의 법적인 지위가 부여되었다. 이 연구는 바로 데이터방송을 방송법에 어떻게 규정하였는지를 검토하고자 한다. 방송법에서는 기존의 방송매체를 중심으로 지상파방송, 종합유선방송, 위성방송으로 구분하던 방송의 분류를 텔레비전방송, 라디오방송, 데이터방송, 이동멸티미디어 방송으로 새롭게 분류하였다. 또한 데이터방송사업자를 정의하고 데이터방송사업자는 승인제도 및 등록제도를 통해 사업을 하도록 하였다. 그러나 데이터방송사업자에 대해서는 편성 규제, 광고 규제 등의 규제가 적용됨으로써, 데이터방송을 방송의 틀에서 규제하려는 입장올 보여주고 었다. 이는 아직 초기 단계에 있는 서비스이며 방송과 통신의 융합형 서비스에 대해 올바른 규제 방식으로 보기 어렵다. 그러므로 데이터방송에 대해서는 기존 방송과 다른 패러다임을 통해 새로운 규제툴을 마련하지 않으면 안된다.

영문 초록

Data broadcasting is a new service which has convergent features between broadcasting and telecommunications. Data broadcasting service began on May 2003 in Korea, from the satellite broadcasting service. However this service has not been stipulated in the former Broadcasting Act. Therefore data broadcasting service providers have had difficulties in the industry. But the new 2004 Broadcasting Act funally allowed legal status for the first time. So this paper examined the legal issues of data broadcasting in the Broadcasting Act. The previous Broadcasting Act classified terrestrial broadcasting, cable broadcasting, and satellite broadcasting, which is based on the broadcasting media. But the new Broadcasting Act classifies television broadcasting, radio broadcasting, mobile multimedia broadcasting, and data broadcasting. Also the law defines data broadcasting service provider, and stipulates licence system for the it, which is on the verge of deregulation. The law still has a old regulatory paradigm for the data broadcastign service. For example, schedule and advertisement regulations for the data broadcasting service show typical broadcasting regulatory system for the new service. This is not a right way for the very emerging service as well as convergent service. Therefore we need a new regulatory framework for the data broadcasting, based on the new paradigm which is quite different from the previous regulation system on the broadcating.
