국문 초록

공인중개사책임에 대해 대법원 판례나 사회전체적인 의식속에서 전문자격사로서의 개업공인중개사의 책임을 확대하는 방향으로 변화하고 있다. 부동산 중개 사고에 대한 법률상의 의무와 윤리적인 의무의 이행과 정책적 개선사항을 도출하기 위해 우선 전문가 책임의 적용가능성을 검토하였으며, 문헌 및 자료조사에 의한 실태분석과 AHP의 통계적 기법을 이용한 실증분석을 병행하여 개업공인중개사의 책임과 관련된 업무경험과 개업공인중개사의 전문가를 대상으로 합리적 의사결정 요인을 분석하고 있다. 설문조사를 바탕으로 가장 시급히 도입되어야 할 정책분야는 공인중개사 과다배출과 과다 경쟁, 불법 중개행위 척결 등 현안과제가 가장 중요하다는 인식은 최근의 공인중개사의 위기의식을 보여 주고 있다. 또한 정책적으로 개선할 수 있는 방안으로 공인중개사의 과다배출에 따른 시험강화와 거래서비스의 선진화 등을 제시하였으며, 일반적으로 정형화된 서면이외에도 개별적으로 의뢰인에 대한 설명의무를 강화하는 것도 예방의 중요한 요소라는 점을 강조하고 있다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES The overall social consciousness changes in the direction of expanding the agent's responsibilities as a profession. Recently, real estate brokerage accidents are caused by insufficient explanations and related information. Accordingly, this study reviewed the applicability of the professional responsibility to understand legal and ethical obligation and to derive policy improvements. (2) RESEARCH METHOD With Analytic Hierarchy Process in conjunction with the empirical analysis was to analyze the rational decision-making factors from the participating practitioners. Spatial range was targeted areas of Seoul and others. Brokers in Seoul and other local brokers were surveyed by 200 data. Using the measurement tools were used in the final part of 160, except for inadequate data analysis. (3) RESEARCH FINDINGS the empirical analysis shows that the perception of agent brokers closely match, the following results were obtained. AHP importance suggests some policy improvements for responsible prevention according to the analysis, the most urgent policies are to be introduced on the basis of survey. It shows the recent urgency of excessive competition, illegal mediation act such issues. 2. RESULTSThe political awareness is a reflection of the fact that the property market is overheating and being competitive, which shows that brokers may be vulnerable to legal and ethical responsibilities. It was presented to the advancement of the qualification of agent's test and a way to improve transaction services and the obligation of information.
