국문 초록

형사사법절차에서의 피해자 보호의 필요성이라는 세계적 조류와 국내의 상황적 필요에 의해 공판단계에서의 피해자의 참가와 권리에 대한 논의는 더욱 활발히 이루어졌고 피해자보호 관련 입법이 진행되는 계기가 되었다. 또한 최근 성폭력 범죄와 아동․청소년 대상 범죄의 급증으로 인한 피해자에 대해 관심이 증가하는 사회분위기 속에서 피해자에 대한 입법적 대처와 보호가 두텁게 이루어지고 있는 가운데 피해자참가제도의 도입 논의 중에 있다. 우리의 경우 피해자의 형사절차 참여 제도 도입을 검토함에 있어 2008년부터 이미 시행 중인 일본의 피해자 참가제도를 모델로 참고하였다. 양국에 있어 범죄 피해자 보호에 대한 인식과 대처가 각국의 상황과 필요에 의해 진행되고 있는 바 각 제도와 법률의 내용과 운영현황의 비교는 의의를 가진다. 이에 우리 법문화에 맞는 제도 도입과 성공적 정착을 위해 선행경험국인 일본의 피해자참가제도의 도입과정에서부터 운영현황과 그 경과분석, 학계와 실무계의 평가와 시행착오, 문제점 등을 다각적으로 검토 한다.

영문 초록

The criminal justice process in victims of the need to preserve of world trends and the situation in our needs, by the trial stage for participation and a discussion on the rights of victims became more active and be a wake-up call for legislation related to victim protection is in progress. Also, the current wave of sexual abuse and children, juveniles, criminal damage was caused by the society increasing interested in coping with the legislation of the victim. and it will protect a victim of the new system to take part under discussion. In the case of our victims of criminal procedure system reviewed the implementation in 2008, from Japan, already in place of victim participation system with the model referred. Awareness and handling of the protection of victims of crime in both our countries are by their respective circumstances and needs be carried out by the content of each institution and what legal and operational status of a comparison with the significance. The introduction process and management current state of Japan's victim participation system is prior implementing countries with a criminal justice legal system similar refrain from the introduction of the victim participation system, able to analyze such problems are derived and Evaluation , by introducing a new system and to reduce the trial and error Upon enforcement, it is believed that the role of the compass can be effectively introduced and fixed.
