양심적 병역거부와 병역법 제88조 제1항 등의 합헌성 여부에 대한 검토

국문 초록

양심적 병역거부의 문제는 우리 사회의 해묵은 숙제 가운데 하나라 할 수 있다. 이미 오래 전부터 양심적 병역거부를 둘러싼 논란이 있었고, 여러 차례 법원과 헌법재판소의 판례가 나왔지만, 아직도 문제는 계속되고 있다. 분명 어떻게 문제를 해결해야 하는지 답은 알고 있는데, 진전이 없는 것이다. 당위의 측면에서 보면, 양심적 병역거부가 인정되어야 한다는 점에는 이견을 찾기 어렵다. 그러나 동시에 양심적 병역거부를 이용한 병역기피를 확실하게 막아야 한다는 점도 분명하다. 양심적 병역거부를 인정함으로 인하여 병역기피가 정당화된다는 인식이 확산될 경우에는 문제가 훨씬 더 심각해질 것이기 때문이다. 이 문제를 해결하기 위한 가장 현실적인 대안, 아니 유일한 대안이 ‘합리적’ 대체복무제의 도입을 통한 양심적 병역거부의 인정이라는 점에 대해서는 이견을 찾기 어려울 것이다. 대체복무제 도입에 관해 지난 10여년 동안 많은 논의가 있었고, 대체복무제의 도입에 관한 법률안이 국회에 제출되기도 했지만, 아직 가시적인 성과는 없다. 그러면 국회가 움직이지 않고 있기 때문에 헌법재판소가 나서야 하는 것일까? 과연 헌법재판소가 앞장서서 -충분한 시간이 주어졌음에도 불구하고 대체복무제를 도입하지 않았고, 그 결과 양심적 병역거부자를 계속 처벌되도록 만들고 있는 - 현행 병역법 제88조 제1항 등은 위헌이라고 결정함으로써 문제가 해결될 수있는 것일까? 양심적 병역거부가 병역의무 부과의 형평성과 직결되어 있으며, 이를 위한 대체복무제도의 도입은 그 내용에 못지않게 국민적 합의의 도출이 중요함을 생각할 때, 이는 헌법재판소의 과제라기보다는 국회의 몫이라 볼 수 있다. 따라서 양심적 병역거부의 문제에 대하여 헌법재판소는 국회의 입법을 촉구하는 선을 넘지는 않아야 한다. 여기서 헌법재판소의 기능법적 한계가 다시금 강조될 필요가 있다.

영문 초록

An issue regarding conscientious objection to military service is one of the age-old issues in South Korea. The dispute over the conscientious objection to military service has been controversial for a long time; and its controversy is still an ongoing issue although the Court and the Constitutional Court of Korea already made several juridical decisions. With an answer to resolve this issue, there hasn't been any progress yet. It is hard to find different perspectives on accepting the system of conscientious objection to military service in terms of its appropriateness. It is clear, however, that draft evasion exploiting the conscientious objection should be thoroughly prohibited as well. When the draft evasion is considered legitimate by adopting the conscientious objection to military service, the situation becomes much worse. There is no doubt that the most realistic and the only solution to resolve this issue is accepting the conscientious objection to military service through adopting a ‘reasonable’ alternative civilian service. The dispute over the alternative civilian service has occurred over the past 10 years and statute pertaining to the alternative civilian service was proposed to the National Assembly; however, there is no clear outcomes yet. The alternative civilian service is not adopted yet even though there are enough times to do; and the Military Service Act Article 88 Paragraph 1 continuously penalizes conscientious objectors. Then should the Constitutional Court take an action in lieu of the National Assembly? Can this issue be resolved if the Constitutional Court judges the unconstitutionality of this statute? The conscientious objection to military service is directly linked to the fairness of imposing the duty of military service; furthermore, national consensus as well as contents of the alternative civilian service is important. Hence, this problem should be resolved by the National Assembly, not the Constitutional Court. Moreover, the Constitutional Court should not exceed the limits of urging the National Assembly to legislate; also, it is necessary to emphasize the functional limitations of the Constitutional Court again in this regard.
