국문 초록

이 글은 헌법과 국가공동체 통합의 관계를 우리나라 제헌사를 통해 탐색적으로 연구한 것이다. 사실 1948년헌법은 남북분단과 남한 내에서도 일부 정치세력들이 배제되어 가는 과정을 통해 제정되었다. 1948년헌법이 헌법제정으로서 정당성을 갖고 국가공동체 통합에 기여했음은 물론이지만, 이러한 점에서 일정한 한계와 과제도 지니게 되었다. 따라서 헌법 제정 과정에서 국가적 통합을 위한 합의는 어떠한 절차를 통해 진행되었는지 살펴보고, 헌법의 구체적 내용들은 국가공동체를 어떻게 통합시키고자 했는지 검토할 필요가 있다. 1948년헌법 제정 절차와 관련해서는 미군정 하에서의 헌법 제정 논의, 헌법제정기구의 정당성, 남북 분단과 헌법 제정과의 관계를 살펴보고자 하였다. 헌법 제정 내용과 관련해서는 민주공화국, 인권, 권력구조, 경제질서, 식민지 청산 등을 중심으로 헌법 제정 논의에서 충분히 다루어지지 못했거나 헌법 제정 참여자 간에 다양한 시각과 해석의 여지를 두었던 점들에 대해 살펴보았다. 이로써 1948년헌법이 제정 당시부터 국가공동체의 통합에 대해 어떠한 과제를 갖고 어떻게 기능하였는지를 파악해보고자 하였다.

영문 초록

This article is an attempt to think about the relationship of enactment of constitution and national community integration in process of creating the korean constitution. In fact, the 1948 Constitution had been enacted in the division of Korea into north and south and even in the elimination of the part of the political forces. The 1948 constitution had the legitimacy as Constitution and was to contribute to the integration of the national community of course, but also has certain limitations and challenges in these respects. Therefore, we reviewed what progress had been for the agreement for national integration in the course of the enactment of Constitution, and how the specific contents of the Constitution integrate the national community. In relation to procedures of the enactment of korean constitution, we look through the discussion under the US military, the validity of constitutional assembly, the relationship between the north-south divide and the Constitution. In connection with the contents of the Constitution, Democratic Republic, human rights, power structure, economic order, and colonial liquidation were examined how these worked for the integration of the national community. As a result, we tried to understand whether the 1948 Constitution had any such problems for the integration of the country community.
