국문 초록

역사적으로 볼 때, 제2차 세계 대전 이후 동서냉전체제와 핵무기에 대한 비밀주의 등을 배경으로 하여 국가의 안전이 중요했었다. 이런 이유로 대통령의 비밀주의인 대통령에 의한 국민이나 연방의회에 대한 정보의 은폐가 나타났다. 그리고 연방의회의 수권이 없는 군사권한의 행사에 대하여 국가의 안전(National Security)이라는 개념은 대통령의 권한행사가 무한정한 광범한 것이라는 점이 많이 지적되었다. 그것을 이유로 시민적 자유권한의 회복이 필요한 시점이었으며, 이를 위하여 대통령의 권한에 대한 제도적 개선의 필요성이 지적된 것이 1970년대 초에 시작되었다. 따라서 본 연구는 미국 연방헌법 하에서 대 테러감시계획으로 나타나는 여러 시책들 중 베트남전쟁을 배경으로 하는 1970년대 이후 긴급사태법제의 전개와 확대에 대해 역사적 관점에서 그 중요성을 찾아보고자 하였다. 본 연구의 근본 목적은 국민이나 의회 그리고 법연구자들은 어떻게 대응하려고 하는지에 대해 알아보고 그리고 긴급사태 법제의 전개와 이전에는 없었던 이 법제의 확대범위에 대해 역사적으로 확인해 본 후에 입헌주의적 대응방안을 모색해 보고자 하는데 있다.

영문 초록

Historically, the national security became important after second World War, especially based on the secrecy of nuclear weapons in the cold war period. This is the reason for existing of information hiding by the president to the congress. The president has simply the overpower in terms of military action, which needs no parliamental approval, in the name of national security. In the early 1970s, such presidential overpower became to be criticized and the necessity of new laws for the power limitation was launched by the civil right organization. Therefore, this study was undertaken to find their importance in the historical perspective on the development and expansion of the emergency legislation since the 1970s to the Vietnam War. This was the part of the terrorist surveillance program under the Federal Constitution for the United States. The fundamental purpose of this study is to investigate the response of National Congress and law expertise due to emergency legislation. The other aim of the study is to suggest the expanding scope of this law after regarding historical view. It might be noble due to this viewpoint.
