국문 초록

이 연구는 현대 프랑스 헌법학의 대표적인 학자인 레옹 뒤기의 헌법이론과 국가이론을 그의 저서 『법과 국가』를 중심으로 체계적으로 이해하고 이를 소개하는 데 있다. 뒤기는 국가에 관한 연구는 실증적이고 현실적인 관찰방법에 의하여야 하며 형이상학적인 이론은 배척하여야 한다는 입장에서 종래의 전통적 국가이론, 특히 권력주의적인 독일의 이론과 개인주의적인 프랑스의 이론을 날카롭게 비판하였다. 그는 주권 관념과 권리의 관념을 부정하고, 뒤르케임의 영향으로 사회적 연대라는 사실에 착안하여 실재론적 국가이론의 구성을 시도한 것이다. 뒤기는 『법과 국가』에서 국가이론을 크게 형이상학적 이론과 실재론적 이론으로 구분한 후, 각각의 이론에서 국가권력에 대한 법적 제한의 문제를 어떻게 다루고 있는지를 추적한다. 즉, 국가를 구속하는 우월한 법적 규제가 있다면 국가는 주권적인 것을 얻지 못하고, 따라서 국가인 것을 얻지 못할 것이라는 점에서, 주권적 국가의 관념과 국가에 우월하여 그 행위를 제한하는 법적 규제의 관념 사이에는 절대적 모순이 존재하는바, 그의 국가이론은 이러한 모순을 어떻게 해결할 것인가 하는 데에서부터 시작되는 것이다. 뒤기는 국가는 명령권을 가진 주권적 권력이 아니며 공공서비스를 조직하고 그 발전을 보증하기 위해 권력을 행사할 의무를 지닌다고 말한다. 그는 종래의 형식적, 논리적 법해석이 지배적이었던 당대의 유명한 이론들에 정면으로 도전하였고, 실재론적 국가이론을 기초로 현실 사회의 갈등을 해결하고자 하였던 것이다. 이는 이념, 지역, 계층 간의 대립과 갈등이 더욱 심화되고 있는 오늘날 한국의 현실에서도 경청할 만한 가치가 있는 것이어서 뒤기의 헌법이론과 국가이론에 대한 깊이 있는 연구과 재평가가 요구된다.

영문 초록

This study aims at understanding and introducing Léon Duguit`s theory of the law and the State by focusing on his work 『The Law and the State』. Léon Duguit has sharply criticized the traditional theory of the State, especially German doctrine that all public law is subjective and the individualistic French doctrine. He adhered to positivism in studying the theory of the State, and therefore he affirmed that we should reject the metaphysical conception. He is critical of notions such as sovereignty and right. L. Duguit, who was influenced by Emile Durkheim`s theory of social solidarity, tried to establish the realistic conception of the state. L. Duguit describes that the theory of the state can be classed under two general categories, namely, the metaphysical and the realistic doctrines, then he makes clear the difference between the two in dealing with the question whether there is a jural principle which is imposed juridically upon the State. There is the unsolvable dilemma between the principle of national sovereignty and the juridical limitation of the powers of the State. His work begins to solve that kind of problem. L. Duguit continued to assert that those who in fact hold the power do not have a subjective right of public power; but they are under the obligation to employ their power to organize public service, to assure and to control its development. He challenged to traditional theories and authority, thus he wanted to resolve a conflict that is prevalent in reality of society by his realistic doctrines. His theory is well worth considering today in Korea, because we also need a solution that can help unify us from our political divide and conflict.
