제2공화국 헌법상의 정부의 불안정 해소방안에 관한 소고

국문 초록

우리 헌정사에서 의원내각제를 채택했던 것은 제2공화국 헌법이 유일하며 5ㆍ16 군사쿠데타로 제2공화국이 단명한 이후에는 계속해서 대통령제를 유지하였다. 그러나 대통령 1인에게 권력이 집중되고 의회가 권력통제기능을 행사하지 못하는 문제점이 나타나면서 권력의 분산의 관점에서 의원내각제에 대한 관심은 계속되었다. 다만, 의원내각제에서는 의회를 중심으로 주요 국가의사결정이 이루어지기 때문에 의회로의 권력의 집중과 그로 인한 의회와 내각 사이의 권력의 불균형, 내각의 빈번한 교체로 인한 정부의 불안정의 문제가 발생할 수 있어 이 문제를 어떻게 해결할 것인지가 문제점으로 지적되었다. 이 글에서는 이러한 문제점들을 해결하기 위한 연구의 일환으로서 제2공화국의 헌법을 연구대상으로 하여서 의원내각제에서 의회와 내각 사이의 권력의 균형을 유지하고 정부의 불안정의 문제를 해소하기 위해서 도입되었던 제도들을 살펴보았다. 제2공화국 헌법에서는 국무총리 임명에 대한 민의원의 신임부여(헌법 제69조), 국무원의 민의원에 대한 연대책임(헌법 제68조), 민의원의 국무원불신임 및 국무원의 민의원 해산권(헌법 제71조) 등을 마련하였다. 그리고 이러한 제도들은 민의원의 의사결정에 민의원의원 재적 과반수의 찬성을 얻을 것을 요구하였다. 제2공화국 헌법을 제정한 정치세력들은 이러한 헌법규정만으로 정부와 의회 간의 권력의 균형이 유지될 것으로 생각하였다. 그러나 문제는 위 헌법규정들 자체보다는 이들 규정들의 전제가 되는 민의원 내 다수파의 형성과 유지 여부이었다. 헌법상의 제도들이 정상적으로 작동할 수 있기 위해서는 정당제도의 안정화와 선거제도의 개선이 필요하였는데, 제2공화국의 의원내각제는 이러한 조건들을 충족하지 못하였다고 할 수 있다. 따라서 만일 우리 헌법이 의원내각제 정부형태를 다시 채택한다면 무엇보다도 내각을 안정적으로 구성하고 지지할 수 있는 의회 내 다수세력을 어떻게 형성하고 유지할 것인가를 고민하는 것이 필요하다. 그러기 위해서는 책임정당제의 구현을 통한 정당제도의 발전과 함께 선거에 있어서 비례대표제의 비율을 높임으로서 정당의 역할을 강조하는 방식으로 선거제도의 개선이 이루어져야 할 것이다.

영문 초록

In the history of the Constitution of Korea, the parliamentary government was only adopted in the second republic of Korea. After the fall of the second Republic by the 5ㆍ16 military coup, the Constitution of Korea has maintained the presidential system. But, because of the concentration of power in the hands of the President and the weakening of the parliament`s functions of power control, people has continued to be interested in the parliamentary government from the point of view of the balance of power. However, in the parliamentary government in which the parliament mainly accomplishes national decisions, the power centralized on the parliament, the power imbalance between parliament and cabinet and the government`s instability can be a frequent occurrence. So a lot of questions were focused on trying to solve these problems. And so, this study is doing research on the introduced institutions for the purpose of relieving the government`s instability in the Constitution of the second republic of Korea. The Constitution of the second republic of Korea stated the confidence of the lower house(Minuiwon) in the appointment of Prime Minister(Art. 69), the responsibility of the cabinet to the lower house(Art. 68) and the motion of censure and the dissolution(Art. 71). And these articles demand the vote of a majority of the total members. The political forces which enacted the constitution thought that the balance of power between the parliament and the government will be done under the new schemes However, in order to operate normally these institutions, the stabilization of the political party system and the improvement in the electoral system were demanded as requirements, but the parliamentary government of the second republic of Korea failed to meet these conditions. Consequently could not exist a stable political supportive forces for the cabinet in the parliament. If the Constitution of Korea adopts the parliamentary government, it is important to work out a way to shape and maintain the parliamentary majority. In order to that, the development of political party system through the realization of the responsible party system and the improvement in the electoral system that emphasize the role of political parties in the election, through the raising importance of the system of proportional representation, will be needed.
