국문 초록

오늘날 행정기능의 확대ㆍ전문화 현상으로 행정입법의 범람을 초래하고 있다. 행정입법의 범람은 의회입법을 침식하고, 헌법의 기본원리인 삼권분립과 법치주의 원리, 의회주의를 형해화ㆍ공동화시킴에 따라 행정입법에 대한 합리적이고 효과적인 통제방안이 요구되고 있다. 지금까지 행정입법에 대한 통제의 수단은 주로 입법적 통제와 사법적 통제에 의존해왔다. 그런데 그 통제의 효율성에 많은 의문이 제기되면서 행정적 통제의 중요성이 부각되고 있다. 행정부에 의한 합목적적인 통제는 행정부가 제정한 행정입법에 대해 스스로 책임진다는 자기 책임적 인식하에 외부적 통제를 배제하고 자기통제에 맡기는 것이 타당하고, 행정의 기능적 독자성을 유지할 수 있으며, 통제의 효과 또한 직접적이고 구체적으로 나타나게 되어 합리적이고 효율적인 통제수단으로 인정되고 있다. 이러한 맥락에서 본고에서는 행정입법에 대한 행정적 통제의 일반론을 개관한 후 우리나라와 외국의 주요 국가인 미국, 영국, 독일, 일본의 행정입법에 대한 행정적 통제를 고찰하고, 외국의 주요국가와 우리나라의 행정입법에 대한 행정적 통제를 비교적 고찰함으로써 우리나라의 행정적 통제에 대하여 주목할 만한 시사점을 얻고, 향후 보다 효율적인 행정적 통제 방안을 위하여 문제점을 도출하고 개선방안을 제시하였다.

영문 초록

Today, the administrative legislation has bring about flooding and various administrative legislation, result from expansion of administrative function and specialization. The flooding and various administrative legislation has erode to parliament legislation, has lose substance separation of legal, constitutionalism, parliamentarism of a basic principle of constitution. therefore should be sought after the control way of effective and resonable to administrative legislation. From now on, the control way to administrative legislations were had been rely on control of parliament and judical control. but, the importance of administrative legislation is being emphasized because of a lot of problems about control of parliament and judical control. Administrative control is appropriate to hold oneself responsible for that administrative department legislated to administrative legislations and would be maintain independent function of administration. or should be appeared to direct effect. so administrative control has been acknowledged to control way of effective and resonable. Therefore, in this study, after considerate common theory to administrative legislation, considerate major foreign countries to administrative legislation. and compare major foreign countries to korea about the administrative control to administrative legislation. so implications deducted noticeable, deduce problems and suggest improvement plan for administrative control way of effective and resonable.
