난민 보호를 위한 인도주의적 개입과 현황

국문 초록

1990년대 유고 지역에서 발생한 수차례 민족 간 분쟁과 내전은 거의 300만명에 가까운 난민들을 양산해 내었으며, 2012년 현재까지도 약 33만여 명은 자신들의 고향으로 귀환하거나 정착하지 못한 채 난민 상태로 남아 있는 상황이다. 이중 본 연구에서는 동유럽 대표 분쟁 지역이자 민족 간 문화 갈등과 분쟁이 계속해서 이어지고 있는 마케도니아를 사례로, 이 지역 난민 문제의 형성 배경 그리고 난민 문제 해결을 위한 국제법적 적용과 EU, UN PKO, UNHCR 등 국제 사회의 노력 및 정책 그리고 난민 현황에 대해 살펴보고자 한다. 무엇보다도 본 연구는 향후 동북아에서의 급변 사태 발생시 대 두될 수도 있는 대량 난민 사태 발생에 대한 우리 정부의 대응 전략 수립에 일련의 도움을 제공할 수 있다는 점에서 연구의 의미가 있다 하겠다. 본 논문의 제 2장에서는 마케도니아에서의 난민 발생 배경을 대외적 요인으론 1998년부터 확대된 코소보 민족 갈등을, 대내적 요인으론 마케도니아 내전(2001)에서 비롯되었음을 제시하고, 그 전개 과정과 특징들에 대해 소개하고자 한다. 제 3장에서는 이 지역 난민 문제 해결을 위한 국제 사회의 개입 및 국제법적 정당성을 UNHCR의 임무와 목적 그리고 평화안인 ‘SCR 1244’와 ‘오흐리드 합의안’에 있음을 제시하고, 이를 비교 분석하고자 한다. 제 4장에서는 난민 문제 해결을 위한 국제 사회의 대응 전략을 EU와 UNHCR 간 전략적 제휴산실인 ‘임시 보호 정책’을 들어 설명하고, 그 외 UN PKO의 역할과활동, 마케도니아 정부의 전략적 선택인 ‘비호와 임시 보호에 관한 법률’ 내용에 대해 분석하고자 한다. 제 5장에서는 논문의 내용 정리와 함께, 동유럽 난민 문제 연구의 의미와 시사점에 대한 본인의 의견을 제시함으로써 논문의 결론을 대신하고자 한다.

영문 초록

In this paper, the historical backgrounds of refugee populations and the legitimacy of international law as a resolution for the refugee problem is studied with focus on Macedonia. Subsequently, the corresponding strategies employed by international organizations such as the UN, UNHCR, EU and UN PKO are analyzed to determine their practicality and efficacy. Macedonia, both internally and externally, has experienced various national problems and conflicts with the advent of democratization and liberalization in the Eastern Europe. For this study, Macedonia was selected among the countries of Eastern Europe due to the typical area of national conflicts among the countries of Eastern Europe, and the exploding refugee problem that occurred as a result of the national conflicts in Kosovo(1998-1999) and the civil war in Macedonia(2001). The structure of this paper is as follows: First, in the Chapter II, the historical background of refugee situation in Macedonia is explained in terms of it originating from the occurrence of national conflicts in Kosovo and civil war in Macedonia. In the Chapter III, the legitimacy of international law as a resolution for the refugee problem in Macedonia is analyzed, with specific reference to the ‘SCR 1244’ and ‘Ohrid Agreement’, which brought about the end of the civil war in Kosovo and Macedonia. In Chapter IV, the correspond strategies of international organizations as solutions to the refugee problem in Macedonia is discussed in terms of the ‘Temporary Protection Policy’ of the UNHCR and EU. Moreover, assistance efforts of UN PKO(KFOR and MFOR) and application of policy(LATP: Law on Asylum and Temporary Protection) between the UNHCR and Macedonia Government on the base of ‘Temporary Protection Policy’ are investigated.
