낙태규제이론의 최근 동향

국문 초록

2007년의 곤잘레스 대 카르트 사건(Gonzales v. Carhart, Carhart Ⅱ)은 2003년에 제정된 연방의 일부낙태금지법이 연방헌법과 연방대법원의 선결례에 어긋나서 무효인가 하는 점을 심리한 사건이다. 이 사건에서 연방대법원은 동법의 일부 용어의 표현이 위헌적일 만큼 애매모호한 것인지, 동법이 임신 2기(3~6개월) 여성의 낙태 선택권에 부당한 부담을 과하고 있는지, 동법이 임신부의 건강보호를 위한 예외규정을 두고 있지 않는 것 자체가 법률 전체를 무효로 할 정도로 위헌적인 것인지의 3가지의 핵심적인 쟁점을 다루었다. Carhart II 법원은 미국에서 30여 년간 낙태규제 법리를 이끌어 온 Roe와 Casey 사건에서의 법리를 재확인함으로써 더욱 공고히 하였다. 동법이 금지하는 낙태를 설명하는 용어가 막연하거나 광범위하지 않고 낙태에 관한 여성의 권리에 부당한 부담도 지우지 않기 때문에 연방대법원은 동법이 헌법에 어긋나지 않는다고 판단하였다. 또한 의학적 불확실성이라는 것이 입법권의 행사를 배제하는 것은 아니기 때문에 건강을 위한 낙태허용 예외를 규정하지 않는 것에 대해서도 법률을 위헌으로 만들만큼 치명적인 것이 아니라고 함으로써 의학적 불활실성에 대처하는 입법부의 재량을 넓게 인정하였다. 또한 낙태금지에 대한 대안의 존재도 법률의 합성성을 뒷받침하는 요소가 되었다. 장차 낙태관련 분야에서의 규제가 어떠한 모습을 띠게 될지는 확실하지 않지만 Carhart Ⅱ 사건이 분명한 하나의 이정표를 제시하였으며, 현재 미국 전역에서 낙태규제의 새로운 시대를 열기위한 준비가 이루어지고 있는 것은 사실이다. 이 글에서는 낙태규제 분야에서 가장 영향력 있는 판결들을 분석하여 Carhart Ⅱ 사건의 판결의 논리 및 선례가 Carhart Ⅱ 사건의 판결에 미친 영향을 분석하고, 향후의 낙태규제에 대한 영향을 살펴보는 것이 목적이다. 끝으로 Carhart Ⅱ 판결이 낙태 법리의 변화와 낙태규제 분야에서의 이른바 입법적극주의가 도래할 수 있는 상황을 마련하였다는 것과 이 판결에서 의학적 불확실성에도 불구하고 입법부의 낙태규제 권한을 확장하는 논리가 머지않은 장래에 낙태규제의 가장 영향력 있는 선례가 될 만한 이유를 짚어 보았다.

영문 초록

Recently, the U.S. Supreme Court decided the issue of whether the Partial-Birth Abortion Ban Act of 2003 was invalid in light of the Constitution and Supreme Court's precedent in Gonzales v. Carhart(Carhart Ⅱ). The three basic issues the Court should decide in Carhart II were as follows. (1) the Act was unconstitutionally vague; (2) the Act posed an undue burden on a woman's ability to choose a second trimester abortion; and (3) the lack of a health exception rendered the entire Act facially unconstitutional. Placing Roe and Casey on solid ground, the Carhart II Court reaffirmed the principles that have guided abortion legislation for the last thirty years in the U.S. In determining the statute was not unconstitutional, the Court held that the Act was not void for vagueness or overbreadth and did not impose an undue burden. The Court also decided that the lack of an exception for the woman's health was not fatal because medical uncertainty does not foreclose the exercise of legislative power, giving legislatures discretion when medical uncertainty existed. Further considerations including alternative measures of abortion also influenced the opinion to uphold the statute. While the future of regulation in the area of abortion jurisprudence remains uncertain, bright guideposts have been erected by Carhart Ⅱ, and legislatures nationwide are preparing for what will undoubtedly be a new era of abortion regulation in the United States. After analyzing the most influential and noteworthy precedents in the abortion regulation arena, key holdings and rationalizations in Carhart II will be observed and its implications for future abortion regulation will be contemplated in this article. In conclusion, I can say that, in due time, Gonzales v. Carhart will prove to be one of the more meaningful and precedential cases in the area of abortion jurisprudence, leaving its own footprint in the field of abortion regulation by expanding the ability of the legislature to regulate abortion. There can be little dispute that Carhart II had abortion jurisprudence changed and an era of legislative activism appeared in the area of abortion regulation.
