스토킹 범죄에 대한 경찰의 대응 강화 방안

국문 초록

스토킹 범죄는 피해자의 신체적ㆍ정신적 안전을 심각하게 위협하는 범죄로, 반복적이고 점진적으로 심화되는 특성을 지닌다. 본 연구는 신당역 역무원살인사건, 인천 논현동 살인사건, 구미 아파트 살인사건 등 대표적인 사례를통해 스토킹 범죄에 대한 경찰의 대응 현황과 한계를 분석하였다. 주요 문제점으로는 초기 대응의 미흡, 접근금지 명령의 실효성 부족, 피해자 보호 프로그램의미비, 경찰의 전문성 부족, 가해자 재발 방지 체계의 미비 등이 확인되었다. 현행 스토킹처벌법이 피해자 보호와 가해자 제재에 대한 기본 틀을 제공하나, 사건 발생 후에도 피해자가 지속적으로 위험에 노출되는 상황을 충분히 예방하지 못하고 있는 실정이다. 본 연구는 이러한 문제점을 개선하기 위해 경찰 대응 강화 방안을 제시하였다. 우선, 사건 초기 단계에서 현장 경찰에 의한 심리적 위험성을 평가하는체계를 확립하고, 접근금지 명령의 실효성을 높이기 위해 형사 처벌과는 별개로‘구치소 등의 유치’를 제안하였다. 또한 다양한 피해자 보호 프로그램의 시행과피해자보호명령 제도를 도입하고, 경찰관의 전문성을 높이기 위한 교육 강화도필요하다. 마지막으로 가해자의 재발 방지를 위한 교육 강화와 유관 기간 간협력 시스템을 구축해야 한다. 이러한 대응책이 효과적으로 시행될 때 스토킹범죄로부터 피해자의 실질적인 보호가 가능해지고 경찰의 대응 신뢰성이 제고될 것으로 기대된다.

영문 초록

Stalking is a crime that seriously threatens the physical and mental safety of victims, and has the characteristics of being repeated and gradually worsening. This study analyzed the current status and limitations of police responses to stalking crimes through representative cases such as the Sindang Station employee murder case, Incheon Nonhyeon-dong murder case, and Gumi apartment murder case. Major problems were identified as insufficient initial response, lack of effectiveness of restraining orders, lack of victim protection programs, lack of police expertise, and lack of a system to prevent recurrence of perpetrators. The current Stalking Punishment Act provides a basic framework for victim protection and perpetrator sanctions, but it does not sufficiently prevent situations in which victims are continuously exposed to danger even after the incident occurs. This study proposed measures to strengthen police response to improve these problems. First, it proposed establishing a system to evaluate psychological risk by police officers at the scene in the early stages of the incident and ‘detention in a detention center, etc.’ separately from criminal punishment to increase the effectiveness of restraining orders. In addition, it is necessary to implement various victim protection programs, introduce a victim protection order system, and strengthen education to enhance the expertise of police officers. Lastly, we need to strengthen education to prevent recurrence of perpetrators and establish a cooperative system between relevant periods. When these countermeasures are effectively implemented, it is expected that victims will be able to receive substantial protection from stalking crimes and the reliability of police response will be enhanced.
