울릉도·독도 지원특별법의 내용과 제정의 필요성에 관한 고찰

국문 초록

현재 경상북도 울릉도․독도 지역은 동해 유일의 접경지역으로서 특수한 지정학적 위치를 차지하고 있다. 또한, 울릉도․독도 지역은 육지에서 130km 이상 떨어져 있고 연평균 80일 이상은 육지로 입․출항할 수 없는 도서(島嶼) 지역이다. 특히, 울릉도는 교통, 의료, 교육, 문화 등 정주 여건이 매우 열악하고 동해 최외곽 도서로서 영토적 중요성(독도로 인해 얻거나 잃게 되는 영토는 대한민국 영토의 60%에 해당한다)을 고려할 때 특별한 지원 대책이 필요한 지역이다. 또한, 국가 영토적 가치와 지속 가능한 독도의 효율적 관리, 그리고 섬의 열악한 환경조건 및 정주 여건을 개선하기 위한 중앙정부의 특별한 조치가 필요한 지역이다. 그래서 섬 주민을 위한 정주 여건 및 삶의 질 개선을 위해서는 물론이고 일본의 독도 침탈 야욕에 맞서는 등 울릉도·독도의 특별한 환경을 위해서는 특별법 제정이 필요하다. 안보에서 매우 중요한 요충지며 국가 영토적 가치와 독도의 지속 가능한 관리를 위해서라도 서해 5도 지원특별법처럼 울릉도·독도 지원특별법이 절실히 요구되고 있다. 이는 육지구역에서 가장 멀리 떨어져 있는 지리적으로 가장 열악한 섬으로 인구가 9000명으로 줄어들 정도로 심각한 위기 상황에 부닥쳐 있는 울릉도의 문제 때문이다. 울릉군은 지속적인 인구감소 및 출산율 저하, 주택 보급률 전국 최하위, 의료서비스 취약 등 정주 여건 악화가 가속되고 있어서 지역소멸 위기를 극복하기 위해서라도 울릉도·독도 지원특별법 제정의 당위성이 있다. 이에 본 연구는 울릉도·독도 지원특별법을 서해 5도 지원특별법과 연계하여 제정의 당위성을 집중적으로 문헌 고찰하여 분석하고자 한다. 본 연구의 구체적인 목적은 첫째, 서해 5도 지원특별법을 분석하여 울릉도·독도 지역의 중요성을 제시하고자 한다. 둘째, 울릉도·독도 지원특별법의 현재가치와 미래가치를 체계적으로 제시하고자 한다. 셋째, 울릉도·독도 지원특별법의 주요 내용 분석을 통해 제정의 당위성을 제시하고자 한다. 문헌 고찰로 김병욱 의원에 의해 대표 발의된 특별법안에 관해 분석한 결과, 그 당위성을 첫째, 울릉도·독도 주민 지원으로 국토균형발전과 섬 주거환경 개선과 삶의 질 향상으로 유입인구 증가와 무인도화를 방지할 수 있다. 둘째, 울릉도·독도에 입도하는 관광객의 증가로 ‘실효적 지배’를 할 수 있다는 점이다. 셋째, 울릉도·독도 관련 조직 설립 등을 통해 효율적 관리와 체계적인 지원을 할 수 있다는 점이다. 넷째, 적극적으로 울릉도·독도 개발사업 등을 추진하여 미래가치를 극대화할 수 있다는 점이다.

영문 초록

Currently, Ulleungdo and Dokdo in Gyeongsangbuk-do occupy a special geopolitical position as the only border area in the East Sea. In addition, the Ulleungdo and Dokdo areas are more than 130km away from the land and are island areas where entry and departure from land are not permitted for an average of 80 days or more per year. In particular, Ulleungdo has very poor settlement conditions such as transportation, medical care, education, and culture, and it is an area that requires special support measures considering its territorial importance as the outermost island in the East Sea. On the other hand, special measures by the central government are needed to improve the national territorial value, sustainable Dokdo's efficient management, and poor environmental conditions and settlement conditions on the island. In particular, it is necessary to enact a special law for the special environment of Ulleungdo and Dokdo, not only to improve the settlement conditions and quality of life for the islanders, but also to fight Japan's ambition to invade Dokdo. It is a very important point in security, and for the sake of national territorial value and sustainable management of Dokdo, the Special Act on support to Ulleungdo and Dokdo, like the Special Act on support to the 5 West Sea Islands, is desperately needed. This is because of the problem of Ulleungdo, which is the most remote and geographically poorest island in the land area and is facing a serious crisis to the extent that its population is reduced to 9,000. In Ulleung-gun, the deterioration of the settlement conditions is accelerating, such as the continuous population decline and birth rate, the lowest housing supply rate in the country, and poor medical service. Therefore, this study aims to intensively examine and analyze the literature on the justification for enactment of the Special Act on Support for Ulleungdo and Dokdo in connection with the Special Act on Support for the 5 West Sea Islands. The specific purpose of this study is, first, to present the importance of the Ulleungdo and Dokdo regions by analyzing the Special Act on support to the 5 West Sea Islands. Second, the present and future values of the Special Act on Support for Ulleungdo and Dokdo are systematically presented. Third, the legitimacy of enactment will be presented through analysis of the main contents of the Special Act on Support for Ulleungdo and Dokdo. As a result of analyzing the special bill proposed by Rep. Kim Byeong-wook through literature review, the justification for it is first, balanced national development through support for residents of Ulleungdo and Dokdo, and prevention of influx of population and uninhabited islands by improving the residential environment and quality of life on the islands. can do. Second, with the increase in tourists entering Ulleungdo and Dokdo, ‘effective control’ can be achieved. Third, it is possible to provide efficient management and systematic support through the establishment of organizations related to Ulleungdo and Dokdo. Fourth, it is possible to maximize future value by actively promoting Ulleungdo and Dokdo development projects.
