국문 초록

일본은 샌프란시스코 강화조약에 의해 일본의 영토가 법적으로 확정되었으며, 쿠릴열도와 독도, 센카쿠제도가 모두 일본의 영토로 확정되었다고 하고 있다. 특히 한국이 샌프란시스코 조약의 기초과정에서 일본이 포기해야 할 지역에 독도를 추가할 것을 요청했지만, 미국은 러스크 국무 차관보의 공식서한을 통해 거부하였으며, 그대로 조약이 확정되었다고 주장하고 있다. 이러한 일본 측 주장의 허실을 살펴보기 위해 본 고에서는 샌프란시스코 조약 성립과정에 관해서 영토조항을 중심으로 고찰해 보았다. 샌프란시스코 조약은 한국전쟁 와중에 체결된 것으로, 당시 동서냉전의 확산이라는 시대적 배경과 소련의 팽창에 대응하기 위한 미국과 영국의 전략적 판단을 기초로 체결된 것이었다. 특히 독도에 대한 처리는 우여곡절을 거친 후에 결과적으로 조약에서 배제되기는 했지만, 그것은 곧바로 일본의 영토로 확정된 것이라고 하기 어렵다. 그리고 일본은 미국의 의사만을 중시하여 러스크 서한과 밴 플리트 보고서를 내세워 미국이 독도를 일본의 영토로 판단하였다고 하고 있지만, 미국은 샌프란시스코 조약에 서명한 49개국 중의 1개국에 불과하며, 미국의 의사가 조약 체결국 전체의 의사를 대변하는 것은 아닐 것이다. 또한 러스크와 밴 플리트의 의견이 미국의 공식적인 의견도 아니었던 것으로 판단되며, 현재까지 미국은 독도문제에 대해 불개입 원칙을 고수하고 있다. 그러므로 일본의 주장은 역사적 사실과 부합하지 않으며, 오히려 사실을 왜곡하는 것이다.

영문 초록

Japan asserts that Japan's territory has been legally established under the San Francisco Peace Treaty, and that the Kuril Islands, Dokdo, and Senkaku Islands have all been established as Japanese territory. In particular, Korea requested that Dokdo be added to the territory that Japan should give up during the drafting of the San Francisco Treaty, but the United States refused through an official letter from Assistant Secretary of State Rusk, claiming that the treaty was finalized as it is. In order to examine the falsity of Japan's claim, this study examined the process of establishing the San Francisco Treaty, focusing on the territorial clause. The San Francisco Treaty was signed during the Korean War, based on the historical background of the spread of the East-West Cold War and the strategic judgment of the United States and Britain to respond to the expansion of the Soviet Union. In particular, the treatment of Dokdo was eventually excluded from the treaty after going through twists and turns, but it is difficult to say that it was immediately confirmed as Japanese territory. And Japan, focusing only on the intention of the United States, put forward the Rusk Letter and the Van Fleet Report, saying that the United States judged Dokdo as Japanese territory, but the United States is only one of the 49 countries that signed the San Francisco Treaty, It will not represent the will of all the treaty partners. In addition, it is judged that neither Rusk nor Van Fleet's opinion was an official opinion of the United States, and the United States has adhered to the principle of non-intervention in the Dokdo issue so far. Therefore, Japan's claim does not correspond to historical facts, but rather distorts the facts.
