고위험범죄자에 대한 사회내 관리제도 개선방안

국문 초록

2007년 한국에서 아동과 부녀자를 상대로 하는 성폭력이나 살인사건이 동시다발적으로 발생하기 시작하자 정부는 ‘전자감독제도’, ‘화학적 거세’ 등의 새로운 정책을 도입하여 실시 중이다. 그러나 2021년 아동성폭력범죄자 ‘조두순’이 출소하고 같은 해 전자발찌 대상자의 연쇄살인 사건이 발생하자 사회 내에서 고위험범죄자 관리에 대한 사회적 관심이 집중되고 있어 이에 대한 대책 마련이 시급한 실정이다. 이 연구는 외국에서 고위험범죄로부터 국민의 안전을 보호하기 위하여 진행되고 있는 특별한 정책들을 문헌 연구를 통하여 고찰하고 한국의 현 실정에서 적용 가능성을 검토하고자 한다. 영국은 이미 아동과 부녀자를 대상으로 하는 잔인한 성폭행 · 살인사건들을 경험하면서 2001년에 MAPPA(Multi Agency Public Protection Arrangement)를 설치 약 8만여 명의 위험범죄자를 관리하고 있으며, 미국에서도 Reentry 프로그램을 통하여 기관 간의 협업과 지역사회 연계를 강화하여 고위험범죄자 관리를 빈틈없이 하고 있다. 한편, 이러한 기관 간 협업을 통한 통제 중심의 고위험범죄자 관리와는 별도로 성폭력 범죄자와 같은 고위험범죄자를 대상으로 ‘회복적사법(Restorative Justice)’의 이념에 입각한 지역사회 내 지원프로그램인 CoSA (Circle of Support & Accountability)와 같은 사회적 지원을 통해 사회 재통합을 실현함으로써보다 근본적으로 문제를 해결하려는 노력도 살펴볼 필요가 있다. 한국의 경우 고위험범죄자의 효과적인 관리를 위한 형사사법기관 간의 협력과 고위험범죄자 사회 내 지원에 대한 인식이 부족한 상황에서 그 적용 가능성을 논의하고자 한다. 물론 외국과 사회 · 경제 · 문화적 차이로 인하여 외국의 제도가 한국적 실정과 맞지 않을 수 있지만, 외국에서 실시하고 있는 제도의 목적이 합당하고 바람직한 방향이라면 새로운 도입을 적극적으로 검토하는 것이 타당할 것이다.

영문 초록

In 2007, when cases of sexual violence and murder against children and women began to occur simultaneously in Korea, the government introduced and implemented new policies such as the 'electronic monitoring system' and 'chemical castration'. However, the release of Jo Doo-soon in 2021 and subsequent murders of those wearing electronic ankles has highlighted the need for better management of high-risk criminals in society. This study examines some meaningful policies that are being carried out to protect the safety of the people from high-risk crimes in foreign countries through literature research and examines their applicability to the current situation in Korea. The UK, having already experienced brutal sexual assault and murder cases targeting children and women, established the MAPPA (Multi Agency Public Protection Arrangement) in 2001 to manage about 80,000 dangerous criminals. The U.S.A is also trying to manage the high-risk criminals meticulously through the collaboration of criminal justice agencies. Meanwhile, apart from control-centered management of high-risk offenders through collaboration of institutions, it is also necessary to examine efforts to solve problems more fundamentally by realizing social reintegration through social support such as CoSA(Circle of Support & Accountability) programs. In the case of Korea, I would like to discuss the applicability of cooperation between criminal justice agencies for the effective management of high-risk offenders and the lack of awareness of support in the society for high-risk offenders. Of course, according to the difference of social, economic, and cultural environment of Korea, foreign systems may not just fit the Korean situation, it will be difficult to introduce foreign systems right away. However, if the purpose of the system implemented in foreign countries is reasonable and desirable, it is necessary to consider actively the introduction of a new system in Korea.
