어린이집 안전사고 사례에서 본 안전사고 유형과 교사의 법적 책임 고찰

국문 초록

본 연구는 어린이집 안전사고 사례를 통해 안전사고 유형과 교사의 법적 책임을 고찰하고자 하였다. 이를 위하여 어린이집에서 발생한 총 22개 안전사고 사례(14개 판례 포함)를 분석하였다. 연구결과는 다음과 같다. 첫째, 어린이집 보육실 놀이에서 미끄러짐 · 넘어짐 · 부딪힘 등의 사고가 발생하였고 판례는 안전사고 발생 시 교사의 주의의무위반을 인정하였다. 둘째, 계단, 현관, 옥상 등의 공용 공간에서 영유아의 넘어짐, 미끄러짐, 부딪힘, 추락사고가 발생하였고 판례는 어린이집 시설물 하자에 의한 어린이집 교직원의 손해배상책임을 인정하였다. 셋째, 실외놀이 중 유아 간 충돌 후 넘어짐 사고, 이후 사망 추정사고, 뾰족한 나뭇가지에 얼굴 긁힘, 눈 부분에 상처 등의 사고가 발생하였고 영유아 안전사고 발생 시 교사의 중대한 과실이 인정되고 사고방지를 위한 어떠한 조치를 취하지 않은 경우에 판례는 교사 및 어린이집이 면책되기 어렵다고 판시하고 있다. 넷째, 급식 시간에 화상, 질식, 기도 막힘 등의 안전사고가 발생하였다, 판례는 과실 인정 범위로 교사가 평소 영유아의 행동 특성, 반응을 인지하고 대비하였는지 보았다. 여섯째, 차량지도에서 차량 역과한 매우 위중한 사망사고가 발생하였고 판례는 운전기사, 교사를 포함한 어린이집의 과실과 책임을 인정하였다. 본 연구는 어린이집 일과에 따라 빈번하게 발생하는 안전사고 유형을 분석해 봄으로써 안전사고 예방을 위한 시사점을 제공하였다. 또한 어린이집 안전사고 발생 시 교사, 보육교직원에게 영유아를 건강하고 안전하게 보호, 감독하여 사고를 방지하여야 주의의무를 강화하기 위한 시사점을 제공하였다.

영문 초록

The purpose of this study is to examine the contents of safety accidents and the legal responsibility of teachers through the case of safety accidents at daycare centers. To this end, a total of 22 safety accident cases (including 14 precedents) that occurred in daycare centers were analyzed. The research results are as follows. First, accidents such as slipping, falling, and bumping occurred during play in the daycare center, and the precedent recognized that teachers violated the duty of care when a safety accident occurred. Second, falls, slips, bumps, and falls of infants and young children occurred in common spaces such as stairs, hallways, and rooftops. In the case law, the responsibility of the school staff for damages caused by defects in the facilities of the daycare was recognized. Third, accidents such as a fall accident after a collision between infants during outdoor play, an accident with presumed death, a face scratch on a sharp branch, and a wound on the eye area occurred. The precedents showed that it is difficult for teachers and institutions to be exempted if a teacher admits a serious negligence in the occurrence of a safety accident for infants and toddlers and does not take any measures to prevent accidents. Fourth, safety accidents such as burns, suffocation, and airway blockage occurred during lunch time. In the precedent, it was considered as the scope of negligence that the teacher recognized and prepared for the behavioral characteristics and reactions of infants and young children. Sixth, the vehicle map included very serious and serious injuries due to over-vehicle fatal accidents. In the case law, the negligence and responsibility of the daycare center including drivers and teachers were recognized. This study provided implications for the prevention of safety accidents by analyzing the types of safety accidents that occur frequently according to daycare routines. In addition, in the event of a safety accident at a daycare center, early childhood teachers and daycare center staff were provided with implications for strengthening the duty of care to protect and supervise young children in a healthy and safe manner to prevent accidents.
