국문 초록

울리히 벡(Ulrich Beck)에 의해 처음 명명되었던 위험사회가 세월호와 코로나 팬데믹으로 현실화되었다. 세월호 사건은 탑승객 신원 미확인, 선박의 부실한 안전관리, 정부의 재난지휘체계 혼선, 최소한 팩트확인 조차 안한 부정확한 보도, 종교와 결탁한 부도덕한 폐해 등 2014년 우리 대한민국의 부끄러운 민낯이었다. 2019년 11월에 갑작스럽게 등장한 코로나 팬데믹으로 우리사회는 여전히 위험에 노출되어 있다. 확진자와 사망자는 증가하고 있고, 사회적 거리두기, 집합금지, 영업시간 제한, 방역패스 논란 등으로 우리는 어떻게 해야 하는지 방향을 잡지 못하고 있는 실정이다. 이러한 상황속에서 2021년 현재 우리는 어떠한 위험에 노출되어 있고, 어떻게 이를 공법적으로 보장하고 있는가를 고찰하였다. 위험을 현실적으로 제거, 통제하는 것은 자연과학의 몫일지라도, 이에 대한 국가차원에서 위험을 법체계 내에서 관리하고 대응하는 것은 공법의 과제이다. 위험에 대한 인식은 시대와 장소에 따라 차이가 있기에 사회철학적 합의를 기초로 한다. 이러한 인식하에 각 시대별 안전구축과제를 살펴보았다. 또한 현행 헌법 규정 속에서의 안전규범을 살펴보고, 국가의 기본권보장의무를 살펴보았다. 현행 헌법체계 내에서는 안전에 대한 확보를 심사함에 있어 과소보호금지원칙에 의해 안전여부를 심사하고 있어, 결론에 헌법상에 안전권의 명문화가 필요함을 주장하였다.

영문 초록

The risk society, first named by Ulrich Beck, has become a reality with Ferry Sewol disaster and Corona Pandemic. The Ferry Sewol incident was a shameful bare face of Korea in 2014, including an unidentified passenger, poor safety management of ships, confusion in the government s disaster command system, inaccurate reports that did not even confirm the facts, and immoral harms of collusion with religion. Our society is still exposed to danger due to the COVID-19 pandemic that suddenly appeared in November 2019. The number of confirmed cases and deaths is increasing, and we are unable to set the direction of what to do due to social distancing, banning gatherings, limiting business hours, and controversy over quarantine passes.In this situation, as of 2021, we considered what risks we are exposed to and how we guarantee them in public law. Although it is up to natural science to realistically eliminate and control risks, it is a task of public law to manage and respond to risks within the legal system at the national level. The perception of risk varies depending on the times and places, so it is based on socio-philosophy agreements. With this recognition, we looked at the safety construction tasks of each era. With this recognition, the safety construction tasks of each era were examined.In addition, safety norms under the current constitutional provisions were examined, and the state s obligation to guarantee basic rights was examined. In examining the securing of safety within the current constitutional system, it was argued that the constitution requires a stipulation of safety rights in the conclusion, as safety is examined according to the underprotection prohibition rule.
