국문 초록

도심지역의 과밀화에 따라 국토 활용의 대상이 최근 지상에서 지하로까지 확장되고 있다. 그러나 지하공간은 지상에 설정된 물권(real rights)과의 권리관계가 명확히 정리되지 않아 재산권 분쟁 등이 발생할 소지가 높다. 이에 지상과 지하 간, 지하 객체 간 경계를 바탕으로 권리관계를 명확히 하기 위한 방안 마련이 시급하다. 본 논문은 지하공간정보 중 지하도상가와 이에 속한 개별 점포들을 대상으로 기구축 공공데이터를 이용해 3차원 공간정보를 구축하고, 공간의 권리관계 정립과 재산권 보호를 위한 등록방안을 마련하고자 하였다. 이를 위해 먼저 기구축 공공데이터인 국토교통부의 브이월드 3차원 실내공간정보, 서울특별시의 서울시 실내지도, 조달청의 BIM 데이터를 이용하여 개별 객체 단위의 3차원 지하공간정보를 생성하였으며, 타 데이터와의 연계·활용, 좌표정보 표현, 사용 편의성 등을 고려하여 최종성과물을 3D PDF 포맷으로 구축하였다. 또한 지하공간 등록을 위해 등록의 대상과 방법을 정립하고, 지상필지와의 권리관계 정립을 위한 물리적 현황정보와 권리적 현황정보 구축방안을 제시하였다.

영문 초록

Due to overcrowded downtown areas, the scope of land use recently extends toward underground space. But, underground space has no clear relation associated with rights to ground and thus there is a high chance of disputes over property rights. In this vein, it is urgent to create a measure to clarify a relation on the ownership based on boundaries between ground and underground areas, and underground objects. This paper aims to build 3D geospatial information on underground shopping malls and their individual stores and to formulate a public registration measure to set the relations between rights and protect the property rights. MOLIT’s Vworld 3D indoor spatial data, Seoul Indoor Map Service, and BIM data of the‎Public Procurement Service have used to construct 3D underground spatial data on individual stores using existing public data. Meanwhile, Final output generated by this paper is a 3D PDF format in order to be used in connection with other data, express coordinate information and offer user convenience. To present a direction for registering underground space, this paper defined the subject and methodology of registration. This paper also worked out methods to construct information of physical statue and right statue to make a relationship of rights with ground parcels.
