국문 초록

토지의 경계는 연속된 토지위에 인위적으로 그어진 선을 말하는데, 한국에 있어서 토지 경계는 지적공부(지적(임야)도)에 등록된 경계점을 연결한 선이다. 이는 토지소유권의 범위를 나타내며 누구나 열람, 발급이 가능하도록 공시하고 있다. 그러나 다양한 원인으로 타인의 소유권을 침해하는 경계 침범이 빈번하게 발생하고 있다. 이러한 경계 침범은 크게 건물에 의한 경계 침범과 동산의 부동산에 부합으로 나뉠 수 있으며, 토지의 실제현황과 지적공부의 등록사항을 불일치하게 만드는 원인중의 하나로 나타나고 있다. 한편 2013년부터 지적재조사법에 따라 토지의 실제현황과 일치하지 아니하는 지적공부를 바로잡기 위해 지적재조사사업을 실시하고 있다. 따라서 지적재조사사업 경계결정에 있어서 보다 객관적인 판단을 이끌어 내기 위한 요소 중 경계 침범에 대한 유형의 분석이 중요하다고 판단된다. 본 연구의 목적은 토지경계 침범 유형을 분석하고, 각 유형에 따른 경계설정에 있어서의 문제점을 도출하여 개선방향을 제시하는 것이다. 이상과 같은 연구목적을 달성하기 위해 토지의 소유권 범위와 경계설정 관계를 정립하였고, 경계 침범 유형인 건축에 의한 경계 침범, 동산의 부동산에 부합, 부동산 위에 적재된 동산 등의 경계설정을 살펴보았다. 연구결과 첫째, 건축에 의한 경계 침범의 경우 지적재조사사업에서 조정금에 의한 일정부분의 보상적 측면이 있다고 판단되었다. 다만 침범 피해자의 권리 보호 및 불법의 합법화에 대한 문제는 해소되지 않는다. 둘째, 토지에 부합된 동산에 있어서는 민법상 또는 지적재조사법상 구제할 수 있는 방안이 없다. 이러한 문제의 근본적 해결방안으로 형질변경 등 사업의 실시에 있어서 반드시 경계복원측량의 명문화를 대안으로 제시하였다.

영문 초록

The boundary of land refers to a line artificially drawn on continuous land. In Korea, the boundary of land is a line connecting the boundary points registered in the cadastral map. This represents the scope of land ownership and is disclosed so that anyone can view and issue it. However, there are frequent violations of boundaries that infringe on the ownership of others for various reasons. These boundary violations can be largely divided into the boundary violations by buildings and matching Real Estate and the chattels, and appear to be one of the causes of the mismatch between the actual status of land and the registration information of cadastral map. Meanwhile, since 2013, according to the Special Act on Cadastral Resurvey, Cadastral Resurvey project has been implemented to correct cadastral map that do not match the actual status of the land. Therefore, it is important to analyze the patterns of boundary violation to draw more objective judgment in the boundary determination of the Cadastral Resurvey project. The purpose of this study is to analyze the types of land boundary infringement, and to identify boundary setting problems according to each type, and to present each improvement directions. In order to achieve the above research objectives, the relationship between the scope of ownership and land boundary setting was established, and boundary invasion by architecture, which is a type of boundary invasion, conforms to the real estate of movable property, and the boundary setting of movables loaded on the real estate, etc. was examined. As a result of the study, first, it was judged that in the case of boundary invasion by architecture, there is a certain aspect of compensation by adjustment funds in the cadastral resurvey project. However, the problem of protecting the rights of victims of infringement and legalizing illegality is not resolved. Second, for movable property conforming to the land, there is no remedy under the Civil Act or the Special Act on Cadastral Resurvey. As a fundamental solution to this problem, documentation of boundary restoration survey was always suggested as an alternative in the implementation of projects such as trait change.
