국문 초록

자연재난은 비정상적인 자연현상이 생명과 재산에 피해를 주는 것으로 인간의 불가항력적인 요소가 주요 요인이 된다. 현대국가에 이르러서는 자연재난에 대해 국가 차원의 대응 방안을 마련하기 위해 법 제도적 조치를 취하고 있다. 북한에서 규범력을 가지고 있는 자연재난 법령은 실제적 운용에 대한 정보가 부족하여 자세한 실태 분석은 어려운 실정이지만 법령에 나타난 내용에서 자연재난에 대처하는 행태를 추정할 수 있다. 백두산 화산 폭발 가능성이 국제사회의 우려를 불러일으키고 있는 것 역시 그 폭발 시기를 예측하여 특정 지울 수 없다는 것 때문이다. 남북관계가 정치적, 군사적 긴장국면에서 서로 적대적 관계를 형성한 상태에서는 남한의 효율적인 협력과 지원은 더욱 어려울 것이다. 북한이 거의 모든 것은 통제하고 있는 현실에서 자연재난 법력의 내용적 실태를 폭넓게 이해하는 방법으로는 북한의 법을 연구하는 것이다. 향후 전개될 남북한 재난협력은 북한의 자연재난 법제의 실태분석을 기초로 한다. 이 연구는 북한의 자연재난 법령의 실태를 분석하여 남북한 자연재난 협력 체제를 구축하기 위한 기초 자료로 활용하고, 이를 통해 북한의 자연재난 법령에 대한 이해를 진작시고 나아가 남북 상생시기 한반도에서 자연재난을 관리하는 구체적인 규범을 만드는 데 기여할 것으로 기대된다.

영문 초록

Natural disasters are abnormal natural phenomena that damage life and property, and human irresistible factors are the main factors. In modern countries, legal and institutional measures are being taken to prepare national countermeasures against natural disasters. The natural disaster legislation that has normative power in North Korea lacks information on actual operation, so detailed analysis of the situation is difficult, but the contents of the legislation can estimate how to deal with natural disasters. The possibility that the volcanic eruption of Baekdusan Mountain is causing concern in the international community is also because it cannot predict the time of the eruption, so it cannot be erased. Efficient cooperation and support from South Korea will be more difficult when inter-Korean relations form hostile relations with each other in political and military tensions. Nearly everything North Korea controls is the study of North Korean law as a way to broadly understand the content of natural disaster law. The future cooperation between the two Koreas will be based on an analysis of the actual situation of the North Korean natural disaster law. This study analyzes the current state of North Korea s natural disaster legislation and uses it as a basis for establishing a natural disaster cooperation system between North and South Korea. It is expected to contribute to the creation of specific norms to manage.
