국문 초록

향후 북한이 외자 유치를 활성화하기 위해서는 어떠한 법제도적 준비사항이 필요할 것인가? 본 연구는 여기에 대한 답을 모색하기 위한 기초연구로서 북한의 외국인투자법제를 개괄하고 외국인투자자의 권리와 이익을 보호할 수 있는 행정소송의 도입 필요성을 검토해보았다. 현행 북한의 행정처벌법에서도 권한 밖의 행정처벌적용금지(제247조), 행정처벌 변경 및 취소(제250조), 신소제기(제252조), 행정처벌적용과 집행에 대한 감시(제254조)와 같은 규정들이 마련되어 있으나 신소제기의 당사자는 공민으로 제한되는 점 등이 문제가 되어 외국인투자가 입장에서는 자신의 권익에 대해 직접 항변할 수 있는 법적 장치가 부족해 보인다. 북한이 외국인투자자의 권리와 이익을 존중하고 보호한다는 신호를 국제사회에 충분히 보여줄 때 외국인 자본도 투자처로서의 북한 시장에 관심을 보일 수 있을 것인데 행정소송의 도입은 이러한 신호 보내기(signaling)의 일환이 될 것이다. 북한도 실정에 맞도록 가능한 수준에서부터 적용하면서 점차 국제기준에 부합하도록 발전시켜나가는 중장기 법제개혁 준비와 계획이 필요하다.

영문 초록

What kinds of legal and institutional preparations are required to promote foreign investment for North Korea? This study suggests an introduction of administrative litigation into the North Korean legal system. After reviewing North Korea’s foreign investment laws comprehensively, I pinpointed that it is necessary to equip legal means for the protection of foreign investor’s rights and benefits. North Korea’s administrative punishment act prescribes prohibition of administrative punishment out of authority(article 247), change and cancel of administrative punishment(article 250), petition(article 252), monitoring over the application and implementation of administrative punishment(article 254). However, the subject of the petition is also limited to North Korean citizens. Foreign investors still do not have sufficient legal means to claim their own rights and interest by themselves in North Korea. It is required to introduce administrative litigation into the North Korea’s legal system in order to facilitate foreign investment and let North Korean legal system be advanced at the international level. An introduction of administrative litigation will be a good signaling of North Korea’s willingness to protect foreign investor’s rights and respect foreign investor’s legal status. For North Korea, it is strongly recommended to prepare legal reform step by step to fit for the international standards.
