선정적 범죄보도가 중형주의에 미치는 영향과 그 완화책으로서 사회적 관용의 필요성

국문 초록

우리 사회 일반시민들은 최근 강력범죄사건들을 경험하면서 분노와 불안을 느끼고 범죄에 대해서 강력한 형벌의 확대·적용을 요구하고 나섰다. 정치권은 여야 모두 이에 신속히 대응하여 유기징역 상한 및 가중형량을 대폭 상향조정하였을 뿐만 아니라, 전자발찌, 화학적 거세 등 다양한 중형주의 입법조치를 강구하였다. 특히 이런 국민적 공분과 불안감, 그에 따라 중형주의 입법에는 매스미디어의 범죄보도가 주요한 영향요소로 지목되고 있다. 물론 미디어의 범죄보도는 시민들에게 무엇이 범죄인지를 알게끔 해주어 자발적 규범준수가 가능하게 해주는 순기능을 한다. 그러나 한편으로 미디어의 상업적 이익 때문에 보다 선정적인 범죄보도 형태를 취함으로써, 일반시민들에게 필요 이상의 공포와 사회적 불신, 그리고 범죄자의 악마화를 초래한다. 이처럼 일반시민들에게 형성된 범죄현실에 대한 왜곡된 인식은 형사사법정책에서 보다 인내심이 필요한 장기적 정책보다는 즉각적이고 엄한 정책의 투입, 즉 중형주의를 요구하게끔 이끈다. 특히 정치권은 이 문제에 대해서 신중히 숙고하기는커녕 오히려 선거승리라는 이익을 위하여 이를 부추기고 이용한다. 그러나 이런 중형주의 입법이 과연 범죄를 예방하고 사회안전을 도모하는지에 대해서는 의문이 크다. 이런 문제점을 이해한다면, 선정적인 범죄보도와 이에 따른 시민들의 반응에 대증요법보다는 신중한 접근이 필요하다. 범죄문제와 형사정책에 대해서 인내심을 가지고 철학적으로 숙고할 필요성이 있다. 이런 철학적 사고를 위해서는 법치국가형법이 기반하고 있는 자유민주주의 사회의 근간인 사회적 관용을 이해하여야 한다. 따라서 형법(형벌)이 문제해결의 만능수단이 아니며 보다 포용적인 형사사법정책의 필요성을 인식해야 한다.

영문 초록

Most citizens of our society felt a public indignation and anxiety from a series of violent crimes and asked for more strict punishments. Political circles, both the ruling and the opposition parties, not only increased the maximum of imprisonment for a limited term and additional sentences, but also established a variety of punitive legislations, such as electronic anklet, chemical castration, etc. Especially, the public indignation and anxiety and then punitive penal legislation significantly results from press reports about crimes. They have good effects which enable common citizens to distinguish between crimes and right behaviors, and thus to observe law and order spontaneously. They, however,produce adverse effects which raise an excessive social fear and distrust as well as a diablilzation of offender as a result of sensationalizing crimes corresponding to every media group’s commercial interests. People’s distorted realization about crime situations by the sensational reporting leads to more immediate and strict criminal policies, namely punitivism rather than to long-term policies which need more patience. Especially, political circles are willing to provoke and use the punitive tendency for winning an election, rather than are pondering on the problems. But it is highly problematical whether the punitive legislations have a positive effect on crime prevention and social security. In the light of the problems, it should be required to approach the problems carefully rather than to take allopathic treatments for sensational reporting crimes and provoked citizens’ reactions. We should ponder crimes and criminal policies with any philosophical thoughts which needs more patience. We should understand the social tolerance, which is the fundamentals of liberal democracy supported by a law-governed country’s criminal law. It is required to recognize a lenient criminal policy and not to realize criminal law(punishment) as a panacea.
