국문 초록

국가의 이름으로 이루어지는 폭력이 생각보다 많다. 국민의 안녕과 복리를 위해 창설된 국가의 운용자들이 국가 활동이라는 미명하에 국민에게 폭력과 협박을 가하는 경우가 많았던 것이다. 그 대표적인 것이 수사과정에서의 고문, 시위에 대한 폭력 진압, 노동운동에 대한 폭력 탄압, 불법적 집단 수용, 정치 테러 등이었다. 해방과 전쟁에 이은 정쟁으로 인해 대한민국 사회는 국가폭력이 심할 수 밖에 없었던 상황이었다. 이 과정에서 수많은 피해자가 속출하였고 피해자의 고통은 현재까지 진행되고 있다. 또한 국가폭력범죄의 일부는 현재도 진행형에 있다. 국가 폭력 범죄는 여러 가지 특징을 갖는데, 상존성, 광범성, 다양성, 심각성, 장기성 등을 들 수 있으며, 국가폭력범죄의 피해 특성으로는 피해의 광범성, 심각성, 장기성, 은닉성, 불분명성 등을 들 수있다. 결론적으로 국가 폭력 범죄에 의한 피해는 회복이 불가능하거나 매우 어렵기때문에 효과적인 대책을 시급히 세워야 한다. 그럼에도 현재는 대책이 극히 미미한 수준에 그치고 있음은 매우 유감스러운 일이다. 국가 폭력 범죄의 대책으로는 정확한 실태 조사를 바탕으로 책임자와 국가 운용자의 사과와 반성, 재원 확보를 통한 충분한 배상, 정신적 충격에 대한 상담과 치유를 효율적이고 장기적으로 실시하여야 한다. 그리고 이러한 대책을 기반으로 하여 피해자 자신의 스스로에 대한 치유도 더해져 국가 폭력 범죄로 인한 피해를 회복시켜 나가야 한다. 이러한 회복이 이루어질 때 사회는 보다 안정되고 진정한 활기를 되찾을 수 있을 것이다.

영문 초록

National crimes of violence have been committed in the name of maintaining nation. Representative national crimes of violence are torture in process of criminal investigation, violent suppression of demonstration, violent oppression of labor movement, unlawful incarceration and political terror etc. South Korea has experienced much big accidents such as Japanese dominating Korea, liberation from Japan, Korean War, dictatorship of Korean presidents, movement of democracy etc. During these changes of Korea, violent offences in the name of national operation has been committed to peple of Korea. Many people were killed, hurt and have undergone all sorts of hardships. Until now these violent offences of nation have been continued. The specific characters of national violent offences are being still in existence,outbreaking in a large extent, diversity, severity etc. The victim’s specific characters of national violent offences are seriousness, consistence in the long run,concealment of hurt, difficulties of healing etc. So countermeasures of healing these hurts have be set up systemetically and efficiently. First, it needs that nation has to investigate exact facts. It needs to attack a problem at the grass-roots of national violent offences and victims. Second, national officers of responsible post apologize injured persons with a true heart. They have to promise prevention of reappearance. Third, nation has to compensate for the victims. Fourth, nation has to establish center of healing physical suffering and mental disease. Fifth, victims themselves have to effort to heal and recover themselves. Efforts of themselves are necessary to live in normal situation. Quitting of national violent offence and healing of victims make Korean society peaceful and stable.
