광주광역시 학생인권조례의 내용과 과제

국문 초록

본론의 논의에서 살펴보았듯이 광주광역시 학생인권조례는 오랫동안의 조례제정운동을 토대로 제정되었으며 입법과정에서 논란이 되었던 학생인권의 제한에 대한 규정도 폐기한 이상적인 조례이다. 광주학생인권조례는 인권의 주체인 학생들이 학교라는 상황에서 동 조례에 규정되어 있는 권리들을 학칙에 의한 제한 없이 보장받을 수 있다는 점에서 한국에서 최초로 제정된 경기도 학생인권조례보다 발전된 것이라고 평가할 수 있을 것이며 현재 제정을 추진 중인 서울특별시나 전라북도의 학생인권조례에도 영향을 미치게 될 것이다. 전문을 포함하여 총 44개 조항과 부칙으로 구성된 광주시학생인권조례는 학생인권 증진계획의 수립, 학생인권의 최대보장의 원칙, 10여개의 학생인권의 목록들 (학습할 권리. 신체의 자유, 프라이버시의 권리, 양심·종교의 자유, 표현의 자유, 자치와 참여권, 적법한 징계절차의 권리, 교육복지권, 문화권, 건강과 안전에 관한 권리), 평등권, 소수자학생의 권리, 청원권, 학생인권위원회의 구성, 인권영향평가, 학생 의회의 설치, 학생인권교육의 의무화. 학생인권구제기구의 설치 등의 내용을 담고 있다. 학생인권조례의 시행을 앞두고 해결해야 할 과제들은 다음과 같다. 첫째, 인권기본조례와 학생인권조례의 관계를 정립하는 일이다. 인권기본조례에 명시된 교육감의 책무는 학생인권조례의 교육감의 책무에 대한 규정에 의해 구체화되고 있기 때문에 광주광역시와 광주광역시교육청은 학생인권을 보장하고 증진하는데 있어 협력관계를 구축해야 할 것이며, 조례의 시행에 있어서는 학생인권계획이 인권기본계획의 일부를 차지할 수 있도록 조정되어야 할 것이다. 둘째, 학생인권옹호위원회를 시민의 대표성을 반영할 수 있도록 잘 구성하여 단순히 교육감에게 자문하는 정도가 아니라 인권계획을 심의하는 기구로 자리 잡아야 할 것이다.인권구제의 효율성을 위해 인권침해에 대한 의견표명과 시정권고의 기능을 조례가 규정한대로 학생인권옹호위원회에 둘 것인지 민주인권교육센타가 맡을 것인지를 명료화하는 일도 시행의 과제로 제기된다. 셋째, 인권구제기구로서 조례에 규정된 민주인권교육센타가 조속히 설치되어야하며, 학생인권침해에 대한 권리구제 절차가 좀 더 구체화 될 필요가 있다. 광주학생인권조례에는 학생들이 학교현장에서 자신의 인권을 침해받았을 때 어떻게 구제신청을 할 수 있을 것인가에 대해 조문에 명확하게 나타나 있지 않다. 광주학생인권조례는 권리의 주체인 학생들의 눈높이에 맞추어 권리구제 절차에 관한 규정들을 명시할 수 있도록 부분적으로 개정될 필요가 있다. 학생인권의 보장은 국가적 차원에서 한국 교육정책의 근본적인 변화와 입시위주 교육의 철폐에 의해 이루어지겠지만 그러한 근본적인 변화가 더디게 온다면 학생인권조례가 학교에서 학생들의 인권을 지키는 최후의 보루로써 역할을 해야 할 것이다.

영문 초록

This research aims at examining the contents of the Ordinance on Human Rights of the Student in Gwangju Metropolitan City(OHRSG) and some issues which might be raised in the process of implementation. OHRSG is the most advanced Students’ Human Rights Ordinance in Korea because there is no restriction to the rights of the student. Any limitation of students’ human rights has to be regarded as a violation of constitutional law and Convention on the Rights of the Child(CRC)OHRSG is composed of preamble and 44 articles in total. OHRSG prescribes the principle of protection of human rights of the student. the best interests of the student shall be a primary consideration. OHRSG also prescribes lists of individual human rights of student such as prohibition of physical punishment, the construction of human rights commission for the student, the implementation of human rights impact assessment, the construction of students’ congress, the enforcement of mandatory human rights education, the construction of the agency and the process for the remedy in the case of violation of human rights. Issues which can be raised in the course of implementation are as follows. First of all, the relationship between the Basic Human Rights Ordinance and OHRSG need to be established. The President of education committee needs to make an effort to cooperate with the city government and coordinate the human rights policy for the students in accordance with the basic human rights policy. Secondly, The human rights commission for the student has to be organized to represent the opinion of lay citizens. the human rights action plan should be fully discussed in this commission. Thirdly, the position and the tasks of human rights center need to be specified to play its role for the effective remedy. The Ordinance on Human Rights of the Student will be able to play an important role as a bulwark for the protection of the basic rights of the student until the education system is fundamentally reformed for the student to be able to emancipate from ‘the hell of (university admission )examination’ in Korea.
