불법사행산업에 대한 규제의 한계와 제도적 대응방안

국문 초록

국내에서 합법적으로 운영되는 사행산업은 경찰청의 허가로 행해지는 복표발행등 사업과 사행산업통합감독위원회의 규제를 받는 경마, 경륜, 경정, 소싸움경기, 체육진흥투표권(토토), 카지노, 복권으로 이루어진 7종으로 이루어져있다. 사행산업통합감독위원회의 통계자료에 따르면, 이들의 매출규모는 2017 년 기준 약 21조 7263억 원인데 반해 불법도박시장의 2015년 기준 총매출 규모가 약 83조 7,822억 원이라고 한다. 온라인에서의 사행산업은 규제가 어려운 실정이다. 불법도박 사이트를 통하여 재산상 이익을 위해 도박 콘텐츠도 같이 만들어지고 사람들도 이에 물들게 됨으로써 사회적 문제를 양산하는 범죄로 존재할수 있다. 도박중독 등으로 인한 사회적 문제, 특히 청소년의 불법도박에의 중독문제도 존재하기에 현 시점에서 가능한 효과적인 단속체계 구축과 합법화된도박의 운영방식을 다루는 범위를 어디까지 둘지 생각해볼 필요가 있다. 이제는 일반도박의 범주에 속하는지 여부를 사정기관이 임의로 판단하는 것이 아니라 죄의 영역에 속하는 금액의 상한과 시간제한을 명확히 정하여 법의 테두리 안에 들어가는 사행산업만의 특성을 가진 단속전문법률로 기준을 정하는등 관리시스템이 다르게 설계되어야 한다. 온라인에서의 생활범위가 확대됨에따라 사행산업을 어떻게 바라볼 것인지 패러다임의 전환이 필요하다. 사회의 사행산업에 대한 부정적인 인식에 근거한 규제일변도 또한 합법적인 사행산업의 발전을 저해할 수 있는 요소이다. 더욱이 온라인상 도박행위의 합법적 범위를 정하여 양성화 및 건전화를 시키는 동시에 불법사행산업 근절이라는 법리적 평가는 이중성을 가질 수밖에 없다. 결국 디지털 환경에서의 도박행위를 현재 국내의 로또 문화처럼 놀이의 영역으로 끌어들이고 포괄적으로 적용할 수 있는 법제 정비가 필요하다고 본다. 위에서 언급했던 입법적 논의에서 등장한 법안들처럼 위원회의 특별사법경찰을 도입하여 불법사행산업에 대하여 확실한 단속을 실시함으로써 합법적 사행산업이 더욱 발전할 환경을 만들어야 하고, 여러 유관기관과 사정기관과의 적극적 협조로 잠입수사 등의 방법을 통하여 처벌의 단계를 구축하여 불법사행산업이 철저하게 단속된다는 인식이 사회 구성원들에게 자리 잡아야 합법적사행산업도 잠깐 즐기는 놀이로서 인식될 수 있을 것이다. 또한 현재의 사행산업통합감독위원회를 조금 더 관리형 기관으로 탈바꿈시킴과 동시에 국무총리소속의 독립적인 중앙행정기관으로 확대 개편하여 보다 신속하고 효율적인 운영이 가능할 수 있어야 할 것이다.

영문 초록

The gambling industry, which is legally operated in Korea, is composed of lottery ticket issuance business regulated by National Police Agency and 7 types of business such as horse racing, cycle racing, ship racing, sports promotion bet(Sports toto), casino, lottery regulated by National Gambling Control Commission(NGCC). According to the statistics of NGCC, the total sales of the illegal gambling market as of 2015 is about 83,782.2 billion won, while the total sales of the legal gambling industry are about 21,723 billion won as of 2017. And it is difficult to regulate the online gambling industry. Gambling contents are created for property benefits through illegal gambling sites, so that it may exist crimes that produce social problems because are involved in. There is also a problem of social problems caused by gambling addiction, especially addiction to illegal gambling by young people. Therefore, it is necessary to think about the scope of dealing with the effective enforcement system and legalized gambling method at present. Now, it is not an arbitrary judgment by the assessment institution whether it belongs to the category of general gambling regulated by the Criminal Law, but rather the criterion law which has the characteristics of only the gambling industry falling within the boundaries of the law, management system should be designed differently. As the range of life on-line expanded, it was time to shift the paradigm of how to look at the gambling industry. Regulation based on the negative perception of gambling industry in society is also a factor that hinders the development of legitimate gambling industry. Moreover, the judicial evaluation that the eradication of illegal gambling industry together with ‘Restoration’ & ‘Bringing into the open’ by establishing a legal scope of online gambling behavior is bound to have duality. As a result, it is necessary to improve the legal system to apply gambling in the digital environment to the field of play like current domestic lotto culture comprehensively. As with the legislation discussed in the above-mentioned legislative debate, by introducing the special judicial police system of NGCC, it is necessary to make developing the legal gambling industry environment by surely enforcing the illegal gambling, to establish the stage of punishment through the method of infiltration by cooperating with related institutions & judicial authorities, in succession, the perception that the illegal gambling industry is strictly enforced is settled to the members of the society, so that the legal gambling industry can be recognized as a play to enjoy for a while. In addition, the current NGCC should be changed into a more manageable institution, at the same time, it should be expanded and reorganized as an independent central administrative institution belonging to the prime minister.
