정신장애 범죄자의 특성에 따른 경찰의 대책방안에 관한 연구

국문 초록

본 연구는 정신장애 범죄자의 특성과 경찰의 대책방안을 살펴보고자 한다. 정신장애 범죄자의 특성은 경찰청의 내부자료를 활용하여 살인, 강도, 절도, 폭력 등을 2015년부터 2017년 까지 자료를 분석하였다. 구체적으로는 정신장애범죄자의 범죄 현황, 범행동기, 보호처분 현황, 전과별 현황, 재범 현황, 생활정도 현황, 범행 시 정신상태 현황 등을 분석하였다. 또한 경찰이 정신장애 범죄자의 범죄 현장에서의 문제점과 이에 대한 대책방안을 강구하였다. 경찰의 정신장애 범죄자에 대한 문제점으로는 첫째, 경찰과 의료기관 등의 정신장애자들에 관한 정확한 정보가 제공되지 않는다는 것이다. 둘째, 지역사회에서 정신장애자의 반복되는 위협행위 등을 파악하기 어려운 상황이다. 셋째, 정신장애자는 범죄를 일으키는 잠재적 범죄자로 판단하는 사회적 편견이다. 이러한 문제점을 중심으로 경찰의 대책방안은 다음과 같다. 첫째, 의료기관 등을 통한 정신장애자 특히 고위험군에 대한 사전 정보가 교류되어야 한다. 둘째, 지역사회에서 반복되는 위협행위 등을 일으키는 정신장애 범죄자는 매뉴얼을 구성하여응급 입원 및 진료가 이루어져야 한다. 셋째, 정신장애 범죄자는 약물로써 치료가 가능하다. 따라서 이들에 대한 선입견은 자제해야 한다. 이러한 연구를통해 정신장애 범죄의 예방방안과 정신장애 범죄현장에서의 체계적인 대처방안이 강구되었으면 한다.

영문 초록

This study examined the characteristics of mental disorder criminals and the countermeasures of the police. The mental disorder criminals classified into the types of crime like murder, robbery, burglary, violence are analyzed by using the inside data of the Korean National Police which is collected from 2015 to 2017. In details, mental disorder criminals’ crime status, motive of crime, status of protective disposal, status of criminal records, status by re-offenders, status of living conditions, and status of mental state at the time of the crime were analyzed. In addition, this study provided problems at the crime scene of mental disorder criminals faced by the police and countermeasures. The first problem is that the police and medical institutions are not provided with the exact information of the mental disorder criminals. Second, it is difficult to figure out the repeated threat of the mental disorder criminals in the community. Third, there are widespread social prejudice that the mentally disabled are potential criminals. Given the problems, firstly for the police, pre-information about the mentally disabled, especially the high risk group, should be exchanged through medical institutions. Secondly, the mentally disabled who repeatedly raise threat should be given an emergency admission and treatment by creating a manuel. Third, as the mental disorder criminals can be cured by taking medication, we should break the prejudice of them. We hope to come up with a preventive plan against the mentally disabled and systemize how to cope with the mental disorder criminals in a crime scene through this study.
