국문 초록

노래연습장, 이용업, 숙박업, 비디오감상실 등 소위 풍속영업은 그 자체로는 사회의 선량한 풍속을 해하는 것이 아니지만, 영업장에서 이루어질 수 있는 불법적 영업행위로 인하여 공서양속에 악영향을 초래하거나, 영업자의 업태 위반 행위 등으로 인하여 풍속범죄 뿐만 아니라 일반범죄로 연결될 수 있기 때문에 지자체 등의 허가 및 단속 등을 통해 규제하고 있다. 이 연구는 풍속영업의 허가관청 및 단속관청과 관련하여, 허가관청은 지자체 이지만 단속관청의 경우 원칙적으로는 지자체임에도 경찰이 실질적으로 단속 업무를 수행하는 현실에서 이에 대한 지자체공무원, 경찰, 시민의 인식은 어떠한지를 살펴보는데 그 목적이 있다. 이 연구에서 중점적으로 수행한 조사연구는 다음의 세 가지로 분류될 수 있다. ① 풍속업소 허가관청 및 단속관청과 관련하여 그 주체를 어떻게 인지하고 있는가, ② 풍속업소 허가관청 및 단속관청이 일치하지 않는 것과 관련하여 일치 필요성에 대해 어떻게 인식하고 있는가, ③ 바람직한 풍속업소 허가관청 및 단속관청에 대하여 어떻게 인식하고 있는가 등이다. 또한 추가적으로 풍속업소 허가 및 단속 업무와 관련한 제언을 개방형 질문으로 포함하였다. 이상의 조사 연구를 바탕으로 하여 연구의 결론 및 함의 부분에서는 연구 결과에서 도출된 사항들을 정책적으로 반영하는데 있어서의 함의 및 방향성을 제시하였다.

영문 초록

Korean business affecting public morals, such as singing room, barbers business, lodging business, video room business do not harm social morality. However, due to unlawful business activities, it can lead to adverse affects on the public good and public affairs, or it can be linked to ordinary crime as well as customary crime due to violation of the business person s business conditions. Therefore, it is regulated through permission and enforcement of local governments. This study is aimed at investigate the perceptions of local government officials, police, and citizens on the fact that in principle permitting agency & crackdown agency is local government, but substantially police conduct crackdown task. Research studies that have been focused on in this study can be classified into the following three categories. (1) how they perceive the subject in relation to the permitting agency and the crackdown agency, (2) how they perceive the necessity of consensus regarding the incompatibility between the permitting agency and the crackdown agency, (3) And how they perceive which is the desirable agency of permitting or crackdown. In addition, open-ended questions were included which is related to suggestions on the permitting activities and crackdown activities. Based on the above research, conclusions and implications of this study are presented in terms of implications and direction in policy reflection of the findings.
