국문 초록

본 연구에서는 내부고발자 보호에 관한 각국의 법 규정과 판례를 살펴보았다. 이러한 과정을 통하여 각국은 구체적인 사정은 다를 수 있지만 내부고발자를 여하히 보호 할 수 있는가에 제도의 초점이 맞춰져 있다는 것을 알 수 있었다. 이는 각국의 판례가 내부고발을 이유로 제보자가 당한 불이익취급을 어떻게 회복시키느냐 하는 문제에 집중되어 있는 것을 보더라도 잘 알 수 있을 것이다. 다만 미국과 일본은 공익성을 가지 는 정보에 대해서는 넓게 보호의 대상으로 삼고 있는데 비해 우리는 비교적 엄격한 입 장으로 판단되어 아쉬운 느낌이다. 향후 우리 공익신고자보호법이 지속적인 개정과 보완을 통해 내부고발자를 보호하는 일반법으로서의 역할을 다 할 수 있기를 기대하는 바이다. 한편 내부고발자 보호제도의 정립은 기업풍토의 개선, 준법경영의 촉진 등을 초래하여 결국 기업의 투명성 확보에 기여할 것으로 판단된다. 따라서 “공익신고자보호 법”을 계기로 우리 기업의 경영진이 적극적으로 기업 투명성 확보에 주력할 것을 기대 한다.

영문 초록

In this study, about whistleblower protection laws and precedent of South Korea, United States and Japan examined. Through this process was found, States may be different, It is the keypoint that How to protect whistleblower. Whistleblower cases in different countries is focused on that how can recovery Whistleblower’s discriminatory treatment. The United States and Japan for the information of public interest as an object of protection is wide. However, we are targeting a relatively narrow protection. In the future, through continuous revision and supplement "Act on the Protection of Public Interest Whistleblowers" This serves to protect whistleblowers, is expected to do well. Meanwhile, if the establishment of whistleblower protection system improvements are made, the corporate culture, compliance management and such is established, corporate transparency is expected to be secured. Therefore, due to the "Act on the Protection of Public Interest Whistleblowers", It is expected that management of companies actively try to ensure of corporate transparency.
