다문화 한부모 가정 지원에 대한 법적과제

국문 초록

최근 우리사회는 결혼 이민자가 증가하고 있는 반면에 다문화가족이 이혼의 증가가 급증함에 따라 사회적 문제가 야기되고 있다. 특히 다문화가정이 우리사회에 안정되기도 전에 해체되어 다문화 한부모 가정으로 변해가고 있는 실정이다. 다문화 한부모 가정에 대한 현행법상 지원법으로 다문화가족지원법, 재한외국인 처우기본법, 한부모가족지원법 등이 있다. 이러한 법들은 다문화가정의 해체를 예방하거나 다문화 한부모가정에 대한 지원체계가 미흡하여 이에 대한 법적 개선과제가 절실히 요구된다. 이 논문에서는 우선 다문화 한부모가정에 대한 현행법상 지원제도를 살펴본다. 그리고 다문화가정의 정착을 위한 지원제도에서 다문화 가정해체문제를 대응하는 지원제도로 전환하는 문제, 혼인해소 등으로 인한 다문화가족여부와 지원문제, 다문화가족에 대한 학교교육 강화문제, 국가와 지방자치단체의 사회적 통합과 문화다양성을 인정하는 사회기반조성문제, 의료지원서비스 강화문제, 다문화 한부모가족문제의 적극적 해결을 위한 다문화가족정책위원회의 조정역할 강화문제, 사회보장적 제도 개선문제 등의 법적 과제를 제시하여 우리나라에서 사회를 통합발전 하는 다문화 사회를 형성하고 다문화가족 공동체가 한부모가족으로 전락하는 것을 방지하여 인간의 존엄과 가치에 이바지 하고자 한다.

영문 초록

Multicultural families, on the other hand, the growing immigrant divorce our society increases more rapidly become a social problem. Under current law, Act of multicultural single parent families for Multicultural Family Support Act, the Act on the Treatment of Foreigners in Korea, and Single-Parent Families Act of These laws prevent the dissolution of the multicultural family support system for multicultural single parent families, or fort he lack of legal improvement initiatives are urgently required. In this paper, we look at the first support system for multicultural single parent families under the current system. The multicultural families whether caused by the problem, and the system to switch to a multicultural family breakup problems corresponding support from the support system for the settlement of multicultural families, dissolution and support issues, streng then school education for a multicultural family issues, and national and local governments problem composition-based society that recognizes the integration of social and cultural diversity issues, medical support services, streng then problem, streng then the coordinating role of the Council for multicultural single-parent families to solve the problem of actively multicultural family policies, social security in stitutions to improve the problem of the legal challenges presented to the integrated development of society and the formation of a multicultural society in Korea to prevent becoming the multicultural community of single-parent families, families to contribute to the dignity and worth of the human.
