장래의 퇴직급여와 재산분할

국문 초록

현재 대법원 판례의 태도에 따르면 장래의 퇴직금은 재산분할의 대상이 될 수 없다. 아직 그 구체적인 권리의 내용이 확정되지 않았기 때문이라고 한다. 그러나 이와 같은 판례의 태도는 이혼 당사자에게 부당한 결과를 초래한다. 장래의 퇴직금 역시 당사자 쌍방의 협력에 의해 형성된 재산임에도 불구하고 이혼시 이를 공정하게 청산받을 수 없기 때문이다. 이혼 당시 상대방 배우자에게 장래의 퇴직금 외에 별다른 재산이 없는 경우에는 더더욱 그러하다. 따라서 장래의 퇴직금도 재산분할의 대상으로 삼지 않을 수 없다. 이를 재산분할의 대상으로 삼는 것이 근로자퇴직급여보장법상 양도금지규정에 저촉되는 것도 아니다. 다만, 이혼 당시 아직 그 권리가 현실화되어 있지 않은 이상 이를 어떠한 방식으로 분할할 것인가는 문제이다. 따라서 본 논문은 장래의 퇴직급여 채권을 재산분할의 대상으로 삼을 필요가 있을 뿐만 아니라, 그것이 법적으로도 가능하다는 것을 전제로, 장래의 퇴직급여 채권을 현물분할하는 방법 및 그에 따른 채무자(즉, 지급의무자)의 법적 지위, 이를 대상분할하는 방법 및 대상분할시 환가의 기준ㆍ시점, 비율인정방식에 따른 분할의 가능성 등 관련 제반문제를 검토한다.

영문 초록

A future retirement allowance cannot be included in the list of property division in the divorce practice, because details of the claim for a retirement allowance is still uncertain. But it results in unfair treatment if a future retirement allowance is not properly paid off at divorce, although the property is built up by the cooperation with his/her spouse as well. It is so all the more when he/she has no property except a future retirement allowance. Therefore that property should be divided. And such a conclusion is not against the law which prohibits the transfer of a retirement allowance. Nevertheless it is still a controversial issue how to divide it, because even a laborer him/her-self cannot expect when and how much he/she can get it. This article is written to suggest an idea about the way to divide a future retirement and its details, such as the legal position of concerned parties, e.g. an employer or a pension provider, the standards of realization of a future retirement allowance, and the possibility of a deferred distribution method etc.
