교육기본권 실현을 위한 전제로서의 교육복지

국문 초록

국민의 교육기본권을 실현하기 위한 전제로서의 교육을 복지의 관점에서 보는 노력이 그 동안 희박하였다. 따라서 국민의 교육기본권을 실질적으로 실현하고 헌법에서 규정하는 “능력에 따른 균등한 교육을 받을 권리”를 보장하기 위한 전제로서 교육복지를 구현하기 위해서는 몇 가지의 우선적인 선결문제가 존재한다. 방법적인 기초로서 교육복지를 정책적으로 시행하기 위한 근거법령의 정비가 요구된다. 현재 산재되어 있는 교육복지 관련 법령과 규정들을 체계적으로 정비하여 하나의 법령을 제정하는 것이 필요하다. 이러한 교육복지의 정책적 근거를 마련한 후에는 그 시행에 들어가는 예산의 확보가 절실하다. 그리고 교육복지 실현의 내용에 있어서는 유아교육과 초․중등교육을 포함하는 기초교육 및 생계를 위한 직업교육은 무상의무교육의 범주에서 이루어지도록 무상교육의 범위를 확대할 필요가 있다. 마지막으로 교육취약집단에 대한 체계적인 실태조사, 정책지원방안, 그리고 교육복지 지원 결과에 대한 평가관리 체계가 수립되어야 한다. 우리의 교육현실에서 교육취약집단에 대한 지원은 주로 학비, 급식비 지원 수준에 머물러 있으나, 교육비지원의 규모도 점차적으로 확대해 나가야 할 것이며, 한편으로는 이들에 대한 지원체계를 수립해야 할 것이다. 여기에는 교육당국, 지방자치단체, 지역사회, 민간단체 등이 망라되어 교육취약집단의 교육적 환경을 효과적으로 조성하는 데 노력을 집중해야 할 것이다.

영문 초록

Efforts viewing from the perspective of welfare education as a prerequisite for the realization of people's educational basic rights was unlikely in the meantime. So people actually realize the basic rights of education provision in the Constitution and the “equal right to education according to ability” as a prerequisite for ensuring the implementation of educational outreach to some of the first issue, there are a prerequisite. Educational welfare policy as a methodological basis for the enforcement of the law maintenance is required. it is necessary to enact the statute are scattered in the current educational welfare laws and regulations and a systematic maintenance. This training laid the basis of welfare policy goes into effect once and it is imperative to secure the budget. it is necessary to expand the scope of welfare and education in Early Childhood Education and comes to the content of Elementary and Secondary Education, including vocational training for basic education and livelihood of the free and compulsory education to occur in the category of free education. Finally, a systematic training in the Survey of vulnerable groups, and policy support measures, and results of assessment should be established for the evaluation and management system. In reality, our educational support for vulnerable groups, mainly education tuition, meals, stay on the level of support, but also boosted the size of the educational subsidy will need to get one hand, support for these systems should be established. This includes education authorities, local governments, communities, private organizations, and educational environments encompass education of vulnerable groups in our efforts to effectively create should concentrate.
