국문 초록

이제껏 우리 사회는 외국의 경우와 비교했을 때, 종교에 대해 상당히 관대한 입장을 취해왔다. 종교단체와 관련해 여러 감세 혹은 면세혜택을 주어온 것이 대표적인 예이다. 또한 특정종교를 건학이념이나 교육이념으로 표방하는 학교들이 학생들에게 종교과목 수강이나 종교행사 참여를 강제하거나 반쯤 강제할 때 이에 대해 크게 문제제기를 하지 않아 온 것도 또 다른 예가 될 수 있다. 그런데 이것이 주요 대도시에서 고등학교 입학이 시험에 의해서가 아니라 당해 지방자치단체 교육청의 학교 배정에 의해 이루어지는 고교추첨제와 결합되면서, 그 학교를 선택해 들어오지 않은 학생들에게 학교가 특정 종교의 교육이나 특정 종교행사에의 참석을 요구하는 상황이 되었고, 이것이 신앙의 자유와 같은 학생의 권리들을 학교가 침해하는 것이 아니냐는 문제를 낳게 되었다. 이것이 구체적 사건으로 사건화 된 것으로 대광고등학교 강의석군 사건이 있다. 학교의 학생에 대한 종교의 자유 침해나 퇴학처분으로 인한 손해배상을 구하는 이 사건에서 일심법원인 서울지방법원은 강의석군의 손을 들어 주었지만, 이심법원인 서울고등법원은 학교당국의 손을 들어주었다. 본 연구는 서울고등법원의 이 사건 판결의 분석과 학리적 비판을 통해 고등학교 학생인 청소년들의 신앙의 자유나 자기결정권 등의 청소년의 권리에 대해 살펴봄을 연구의 목적으로 한다. 이를 위해 우선 서울고등법원 판결의 요지를 살펴보고 일심법원 판결인 서울중앙지방법원 판결과 비교해 본 후, 이 사건에서 학교측의 어떤 기본권이 주장될 수 있고 또 학생들은 어떤 기본권 침해를 주장할 수 있는지를 검토해 본다. 그리고 나서 이 사건을 기본권 충돌의 관점과 법익형량이론의 관점에서 분석해보고, 외국의 유사판례와 비교해 본 후, 약자의 권리보호라는 사법부 사명의 관점에서도 조명해보고자 한다.

영문 초록

Korean society has maintained fairly generous attitudes to the religions compared with foreign countries so far. For an example, it has given tacit consent for the private schools to compel the students, directly or indirectly, to enroll the religion courses and to participate in the religious meetings held by the schools themselves that claimed to stand for the specific religions as their ideas of education. By the way, many big cities in Korea including Seoul have adopted the lottery system for high school entrance up to these days. As a result, the high school students who didn't choose the high school at their own will have been compelled to enroll the religion courses and to participate in the religious meetings held by the school after they come into the high school. This brought the issue of whether the coercion by the school infringed upon the constitutional rights of the students such as the freedom of belief. This issue became the main issue in Kang Eui-Seok case who attended Dae-gwang High School. In the first instance of the case where the former high school student named Kang Eui-Seok brought the suit against Dae-gwang High School for his damages incurred by the school's infringement upon his freedom of belief and the expulsion of him from the school, Seoul District Court ruled against the school. However, Seoul Higher Court ruled for the school in the second instance. This paper aims at examining the rights of the youths such as the freedom of belief and the right of self-determination of the high school students by analyzing the Seoul Higher Court's decision and criticizing the problems in the reasoning of the decision. To achieve this aim, first of all, this paper reviews the summary of the decision by Seoul High Court, compares it with the summary of Seoul District Court's decision, and explores what kind of constitutional rights could be invoked by the school and by the student. And then, it explains the case in terms of the conflicts of the constitutional rights as well as the balancing of the interests, compares the case with similar cases in the United States and Germany, and finally analyze the case in terms of the protection of the rights of the minority.
