조약체결에 관한 국회의 통제권

국문 초록

  ‘국가간에 서면의 형식으로 체결된 명시적 합의’를 조약이라 한다. 조약은 ‘일반적으로 승인된 국제법규’와 함께 국제법을 구성한다. 우리 헌법 제6조 제1항은 “헌법에 의해 체결ㆍ공포된 조약과 일반적으로 승인된 국제법규는 국내법과 같은 효력을 가진다.”고 규정하면서 국제법질서 존중원칙을 천명하고 있고 국제법인 조약의 국내법적 효력을 인정하고 있다. 또한, 헌법 제60조 제1항은 그 체결ㆍ비준에 민주적 통제의 하나로서의 ‘국회 동의’를 요하는 중요한 조약들을 열거하고 있다.
  ‘조약’이라는 규범이 이렇듯 헌법에 의해 국내법적 효력을 가지는 규범이며, 세계화의 진전에 힘입어 국민생활에 더더욱 많은 직접적 영향을 미치고 더 나아가 국민의 기본권을 제한할 수도 있는 규범이라는 측면에서 바라봤을 때, 이러한 조약체결에 대한 국회의 통제권에 관해 보다 깊이있는 헌법적 논의가 꼭 필요하며 시급하다고 믿는다.
  본 연구에서는 대통령의 조약체결 및 비준권의 내용과 범위, 이를 견제하는 국회의 조약체결에 대한 통제권으로서의 국회동의권의 내용과 범위에 대해 학설 및 판례의 입장뿐만 아니라 실무관행의 현실까지도 자세히 살펴본다. 그리고 ‘조약의 형성과 관련한 대통령과 국회의 권한 배분’이라는 관점에서 조약체결에 대한 국회의 통제권 강화방안을 모색해보고 그 한 방법으로 작년에 국회에 제출된 바 있는 조약체결절차법안의 내용에 대해서도 검토해본다. 또한 끝으로 이러한 국회의 조약통제권 강화의 측면에서, 얼마 전 촛불시위를 불러온 미국산 쇠고기 수입 위생조건 고시의 문제점에 대해서도 살펴본다.

영문 초록

  The treaty is defined as ‘the written agreement between the nations.’ It constitutes international law with ‘the generally recognized rules of international law.’ Article 6 Section 1 of Korean Constitution explicates ‘Doctrine of Respecting International Law Order’ and acknowledges a treaty"s force same as a domestic law by prescribing “Treaties duly concluded and promulgated under the Constitution and the generally recognized rules of international law shall have the same effect as the domestic laws of the Republic of Korea.” In addition, Article 60 Section 1 of Korean Constitution enumerates the important treaties that need the consent by National Assembly as a democratic control in the conclusion and ratification of the treaties.
  Like this, the treaty is a norm to which Korean Constitution gives domestic force. It is also a norm which would give more and more impact to Korean people"s life due to the development of globalization, and, further, could limit the constitutional rights of Korean people. Considering these facts, I believe that in-depth constitutional studies on National Assembly"s control power in treaty-making are fairly needy and urgent.
  In this paper, I will closely examine governmental practices in real world as well as scholarly theories and judicial decisions on the contents and scopes of treaty-concluding and treaty-ratifying powers of the President and consenting power of National Assembly on treaty-making as a control power for the checks and balances. In addition, I will analyze and review ‘the congressional bills on treaty-making process’ which were submitted to National Assembly last year and explore the way to strengthen the National Assembly"s control power on treaty-making from the standpoint of a desirable power distribution between the President and National Assembly. Finally, in terms of strengthening National Assembly"s control power in treaty-making, I will reveal the problems on official announcement of sanitation standard in importing beef from the United States which caused so-called ‘candle rallies’ by Korean people until couple of months ago.
