미국 헌법상 조약 종료에 대한 의회의 권한

국문 초록

  세계 주요 국가의 헌법은 일정한 조약의 체결에 의회의 동의가 필요하다는 점만을 규정할 뿐, 조약을 종료하는 절차에 대해서는 아무 규정을 두고 있지 않다. 이런 헌법의 불분명함은 조약의 종료를 둘러싼 대통령과 의회의 권한 관계에 해석상 논란을 불러일으킨다. 그러나 오늘날의 세계화 시대에 조약 종료는 조약 체결과 마찬가지로 국민의 권리와 의무 및 국가 재정에 상당한 영향을 미친다. 또한 조약의 체결과 종료는 국가 외교 정책의 본질적인 문제를 내포하고 있으며, 오늘날의 민주화 시대에 대통령직의 위상은 크게 약화되고 있다. 이런 점들을 고려한다면 조약 종료를 대통령의 독점적 영역이라기보다는 대통령과 의회가 공동으로 관여하는 영역으로 보아야 한다. 그렇다면 의회는 어떤 방식을 통해 조약 종료에 관여할 수 있는가? 이 문제가 헌법 학계에서 가장 활발하게 논의되어온 국가는 바로 미국이다. 구체적으로 미국 헌법 학계에서는 대통령의 조약 종료에 대해 상원이 동의권을 행사할 수 있는지 여부, 또 의회는 조약 종료를 목적으로 하는 법률을 제정할 수 있는지 여부 등이 논란이 되어 왔다. 바로 이 글에서는 이런 미국에서의 논의를 중심으로 의회가 조약 종료에 대해 주장할 수 있는 헌법상 권한을 논증해보고자 한다.

영문 초록

  Although the Korean Constitution requires joint action by the President and the National Assembly for the making of some treaties, it does not address the question of treaty termination. Judging by some American constitutional theorists, it is appropriate for the National Assembly to play a role in the process of terminating treaties.
  First, the Korean Constitution explicitly guarantees the National Assembly participation in the process of making some treaties. From this cause, the National Assembly can take part in the treaty termination process. But a majority vote rule should not apply with respect to treaty termination because treaty termination is less perilous and important than treaty conclusion.
  Second, the national Assembly can pass the legislation to replace the domestic effects of an existing treaty that is self-executing. Also, it is able to refuse enacting a law to implement a treaty that is not self-executing. But these legislations cannot have international effects. To terminate the international effects of a treaty, the National Assembly have to pass a law that force the president to give notice of termination of a treaty to the other Contracting State. The president is obligated to obey this law because he has the constitutional duty to faithfully execute the laws. But in actuality, there are likely to be many limits for compelling the president to deliver notice of termination of a treaty through legislation.
