학생의 기본권에 관한 몇 가지 문제

국문 초록

  이 글은 학생(특히 중등학교 학생)의 기본권 보장에 관한 구조적 취약성에 대해 살펴본 다음, 사립학교에서의 종교교육, 체벌, 두발규제와 같은 몇 가지의 현안들에 대해 구체적으로 검토한다.
  학생은 미성년으로서 일반적으로 미성숙하다고 간주된다. 이들은 또한 보호ㆍ교육대상이며 학교생활을 하므로 보호나 교육목적, 학급의 질서유지를 위한 여러가지 규율을 적용받는다. 이러한 점들로 인해 학생에게 특별한 배려와 혜택이 제공되지만, 반면 이는 학생의 기본권 보장에 구조적 취약성을 초래하는 요인이 되기도 한다. 정치적으로는 이들의 의사가 반영될 수 있는 통로가 제한되어 있다는 점에서 이들은 소수자의 특징을 가지고 있다. 학생의 기본권 보장의 취약성을 보완하기 위해서는 기본권 침해가 의심되는 위 현안들에서 보듯 법령의 재정비가 필요하다. 또한 이러한 문제들을 다루는 사법심사에서도 적정한 심사기준 적용과 입증책임 분담으로 실질적 심사가 이루어져야 한다.

영문 초록

  This article examines the vulnerability to violations of constitutional rights of student(especially secondary school student) and looks into a couple of related issues.
  Students are considered immature as they are under a certain age. Many rules are imposed on them for their protection and education, or to keep order in classrooms. These factors cause weakness in the protection of their constitutional rights. They are minorities in that they are not represented adequately in the political process. Considering the susceptibility to infringement of their constitutional rights, reforms are needed for laws and educational systems which facilitate violations of student constitutional rights. Judicial review should have some teeth through the application of adequate standard of review and fair placement of burden of proof.
  Compulsory religious education in private schools is unconstitutional under our present education system which does not allow school choice. Corporal punishment has to be outlawed to prevent misuse. Excessive hair style regulation can hardly be justified because of the vagueness of its purpose.
