무형문화재 종목의 지정 해제와 재지정에 관한 소고

국문 초록

본 연구는 2021년 11월, 문화재 ‘지정번호’ 제도 개선을 계기로 무형문화재 종목의 지정해제 및 재지정에 대한 전개와 흐름을 고찰하는데 의의를 두었다. 이를 위해 무형문화재 관계 법령의 변천을 검토하고, 지정 해제 및 재지정의 실태를 파악하여 개선방안을 모색하였다. 1962년 『문화재보호법』시행 이래 국가 및 시도무형문화재는 797종목이 지정되었으며, 67종목이 지정 해제되었다. 이 중에서 29종목이 재지정되어 759종목이 전승되고 있다. 지정 해제된 67종목의 사유는 ‘보유자의 사망(29종목)’, ‘국가무형문화재 승격 지정 (14종목)’, ‘타 지자체 이관(8종목)’, ‘종목의 통폐합(6종목)’, ‘기타 사유(10종목)’이다. 지정해제된 67종목 중에서 재지정은 29종목이다. 부산무형문화재, 광주무형문화재, 제주무형문화재는 지정 해제된 종목이 모두 재지정되었다.(100%) 다음으로 국가무형문화재(71%), 경기무형문화재(56%), 전북무형문화재(56%), 전남무형문화재(40%), 경남무형문화재(40%) 등이 다수로 재지정되었다. 지정 해제된 무형문화재 종목의 재지정은 불가피하다. 무형문화재 종목의 지정 해제가 예술적, 학술적, 역사적 가치 훼손이나 심각한 결격 사유로 인한 경우는 드물기 때문이다. 그러므로 무형문화재에 대한 국내외적 인식, 종목에 대한 사회적 관심, 관계 법령의 제도적 변화 등에 의해 재지정될 가능성은 매우 높다. 이러한 무형문화재 종목의 전승과 보급을 위해서는 지정 해제를 최소화하고, 재지정을 위한 제도적인 근거를 마련해야 한다. 『문화재보호법』과 『무형문화재 보전 및 진흥에 관한 법률』에 의해 지정된 무형문화재 종목은 우리가 전승해야 할 소중한 문화유산이다. 본 연구를 근간으로 무형문화재 종목의 재지정에 대한 법률적, 제도적 방안이 마련되기를 고대한다.

영문 초록

This study investigated the status of the cancellation and re-designation of Intangible Cultural Heritage(ICH) items after the improvement of the cultural heritage “designation number” in November 2021. And it is a consideration of improvement measures for re-designation of ICH. Since the enforcement of the『Cultural Heritage Protection Act』in 1962, 797 items have been designated, but 67 items have been lifted. Among them, 29 items have been re-designated and 759 items have been handed down. The revocation of designation of National and City/Do ICH is 67 items, and five reasons have been derived. 29 items(43%) for ‘death of holders’, 14 items(21%) for ‘designation to National ICH’, 8 items(12%) for ‘transfer to other local governments’, 6 items(9%) for the ‘consolidation’, and 10 items(15%) for ‘other reason’. Of these, 29 items have been re-designated. ICH in Busan, Gwangju, and Jeju were all re-designated(100%) after they were revocation of designation. Next, a number of ICH such as the Cultural Heritage Administration(71%), Gyeonggi-do(56%), and Jeollabuk-do(56%) were redesignated. On the other hand, Incheon and Sejong do not have any revocation of designation. Re-designation of ICH that have been de-designated is unavoidable. Because de-designation of ICH is rarely due to damage to artistic, academic, or historical values or serious disqualification. Therefore, the possibility of re-designation is very high due to domestic and international recognition of ICH, social interest in the item, and institutional changes in related laws and regulations. For re-designation of such ICH items, the cancellation of designation should be minimized and institutional grounds for re-designation should be prepared. ICH items designated by the『Cultural Heritage Protection Act』and『Act on the Conservation and Promotion of Intangible Cultural Properties』are precious cultural heritages that we must pass down on to future generations. It is expected that legal and institutional measures for the redesignation of intangible cultural assets will be prepared based on this study.
