문화재교육 입법의 의의와 과제

국문 초록

2019년「문화재보호법」개정을 통해 문화재교육의 입법이 이루어졌다.「문화재보호법」이 제정된 1962년 이후 60년 문화재보호정책 역사에서 중요한 전환의 의미를 가진 입법이라 할 수 있다.「문화재보호법」에서 문화재교육이 조문화 된 것은 문화재보호가 문화재 보존 중심에서 문화재 향유를 중심으로 문화재보호체계가 전환될 수 있는 중요한 계기를 제공하기 때문이다. 2019년 문화재교육 입법을 통해「문화재보호법」은 문화재교육의 정의와 범주를 정하고, 문화재교육 실태조사를 실시하도록 하고 있으며, 문화재교육지원센터를 지정할 수 있도록 하였고, 문화재교육 프로그램을 인증할 수 있도록 하였다. 그러나 이와 같은 입법 내용들은「문화예술교육지원법」에 따른 문화예술교육과의 관계, 문화재교육프로그램 인증제의 규제성 여부 등 일정한 쟁점을 갖고 있기도 하다. 문화재교육이 이전의 보존중심 문화재보호체계와 다른 방식의 문화재정책이라 할 때, 문화재교육이「문화재보호법」내에 규정되는 것 보다는 독립적인 법률로 제정되는 것이 바람직할 것으로 보인다. 아울러, 이러한 법률 제정에서 현재의「문화재보호법」내에 불비한 문화재교육전문인력 양성과 지원에 대한 입법과 문화재교육의 주체인 문화재교육 전문인력의 체계적인 양성을 통해 문화재교육의 발전을 모색할 필요가 있으며, 또한 역사교육이나 문화예술교육과 차별화된 문화재교육의 고유영역을 정립해 나갈 필요가 있다.

영문 초록

Cultural heritage education was legislated through the revision of the「Cultural Heritage Protection Act」in 2019. The provision of cultural heritage education in the 「Cultural Heritage Protection Act」provides an important opportunity to change from a cultural heritage policy centered on preservation to a cultural heritage policy centered on enjoyment. Therefore, this is a legislation that has a significant turning point in the history of cultural heritage protection policy 60 years after the enactment of the 「Cultural Heritage Protection Act」in 1962. Through the Cultural heritage education legislation in 2019, the「Cultural Heritage Protection Act」sets the definition and category of cultural heritage education, requires that a survey on the current status of cultural heritage education be conducted, designates a cultural heritage education support center, and certifies cultural heritage education programs. However, these legislative contents also have certain issues such as the relationship with culture and arts education according to the「Culture and Arts Education Support Act」, and whether the cultural heritage education program certification system is an administrative regulation. Considering that cultural heritage education is a cultural heritage policy that is different from the previous conservation-oriented cultural heritage protection system, it would be more desirable for cultural heritage education to be enacted as a single law rather than stipulated in the「Cultural Heritage Protection Act」. It is necessary to seek the development of cultural heritage education through legislation on nurturing and supporting cultural heritage education experts, which is insufficient in the current 「Cultural Heritage Protection Act」, and systematic training of cultural heritage education experts, the main body of cultural heritage education. In addition, it is necessary to establish a unique field of cultural heritage education differentiated from history education or culture and arts education.
