국내 어린이집 성학대 판례 연구

국문 초록

본 연구는 법원 소송에 이른 국내 어린이집의 성학대 판례의 동향과 쟁점 사항별로 심층 분석하여, 어린이집의 성학대 예방을 위한 기초 자료 제공과 대안 마련이 목적이다. 이를 위해 영유아보육법에서 어린이집 학대 예방 강화를 위한 법 개정이 이루어진 2015년 5월부터 2019년 12월 말까지 법원에서 판결된 성학대 관련 13건(1심 7건, 2심 4건, 3심 1건)의 판례를 분석하였다. 본 연구의 분석 결과 첫째, 성학대 사건 중에서 법원 소송에 이른 유형은 성폭력처벌법의 13세미만 미성년자 강제추행과 아동복지법의 음행강요·매개·성희롱 등으로 나타났다. 둘째 성학대 가해자는 보육교사, 차량기사 등이고, 법원의 판결은 징역형, 집행유예, 병과형(성폭력치료프로그램, 사회봉사 등)다양하게 나타났다. 그리고 성학대와 관련된 판례의 주요 쟁점사항은 고의가 없이 훈육 차원에서 발생한 성학대 판단, 피고의 무죄 주장에 대한 피해아동 진술에 대한 신빙성, 양형부당, 지적장애 등 피고인의 심신장애 판단으로 나타났다. 상기 연구 결과를 바탕으로 어린이집 성학대 예방을 위한 학대 예방 및 인권 교육의 지속적 강화, 성학대의 양형인자 감경요소의 재고 및 가중요소의 명확한 판시와 처벌 수위 확대 등을 제언하였다.

영문 초록

This study aims to provide basic data and alternatives preparation to prevent sexual abuse in daycare centers by analyzing in depth the trends and issues of sexual abuse precedents, that have reached court litigation, in daycare centers in Korea. To this end, the 13 precedents (7 at 1st trial, 4 at 2nd, and 1 at third) related to the court-determined sexual abuse were analyzed from May 2015, when the Infant Care Act was revised to strengthen the prevention of abuse at daycare centers, to the end of December 2019. As a result of this study, first, the types of sexual abuse cases that resulted in court cases were forced indecent assault on minors under the age of 13 in the act on sexual crime of violence, and coercing or arranging lewd acts by coercion, and sexual abuse in the Child Welfare Act. Second, the court s ruling against them were varied including prison sentence, probation, and cumulative sentence (Sexual Violence Treatment Program, Community service, etc). The main issues of the case related to sexual abuse were the judgment of sexual abuse that occurred unintentionally in terms of discipline, the credibility of the victim s statements against the defendant s claim of innocence, improper sentencing, and the judgment of the defendant s mental and physical disabilities such as intellectual disability. Based on the results of the above study, it suggests the effective abuse prevention and the continuous strengthening human rights education to prevent sexual abuse at daycare centers, and the consideration of the reduction factors in sentencing of sexual abuse and the clear judgment of increasing factors and the expanding level of punishment.
