기간제교원 차별의 합리성에 대한 법적 검토

국문 초록

이 연구는 기간제교원에 대한 신분, 임금, 기타 근로조건에서의 차별현황을 분석하고, 법적 기준에 의해 차별이 합리성 여부를 판단하였다. 기간제교원 차별현황은 각 시도교육청 『계약제교원 운영지침』을 분석하였고, 차별 여부를 판단할 비교 집단을 정규교원으로 설정하였다. 정규교원과 기간제교원 간 차별의 법적 합리성 판단 기준은 엄격한 심사기준으로 하였고, 세부 기준인 차별 목적의 정당성, 차별 대우의 적합성, 차별 대우의 필요성, 차별 대우의 비례원칙을 차례로 판단하였다. 연구결과는 첫째, 현행 계약제교원 운영 지침 분석 결과 정규교원과 기간제교원 간 법적 신분, 임금, 기타 근로조건에서 상이점이 발견되었다. 둘째, 이러한 정규교원과 기간제교원의 차별은 엄격한 심사기준의 세부 기준들을 충족하지 못하는 것으로 법적으로 합리적 차별이 아니다. 셋째, 기간제교원의 임기제 공무원화를 제안하고, 학생 교육의 질을 높이기 위해 기간제교원의 처우 개선을 위한 법령이나 기간제교원 정책의 재검토가 필요하다.

영문 초록

This study analyzed the fact of discrimination in terms of legal status, wages, and other working conditions for Full-time teachers and temporary teachers and judged whether discrimination is reasonable by legal standards. The working conditions of temporary teachers is analyzed according to the instruction manual of contracted teachers at each city or province office of education. The criteria for judging legal rationality of discrimination between Full-time and temporary teachers were based on the strict judging criteria and judged in order of the justification of the purpose, discrimination purpose, suitability, necessity and proportional principle of discrimination treatment in turn. The results of this study are as follows: First, there is a difference in legal status, wage and other working conditions between Full-time and temporary teachers. Second, the discrimination between regular Full-time and temporary teachers does not meet the strict criteria for judging standards, which is not a legal discrimination. Third, it is necessary to review the statute and policy of temporary teachers to improve their working conditions. the improving the temporary teacher’s working conditions will contribute to the quality of education.
