국문 초록

본 연구는 스토킹 잠정조치 위반자의 재범 특성과 위험요인을 분석하여 예방적 개입방안을 제시하고자 하였다. 이를 위해 스토킹범죄 관련 1심 선고판결문을 분석하여 인구통계학적 특성, 범죄 관련 특성, 스토킹행위유형을 코딩하였다. 분석결과, 재범집단은 초범집단에 비해 인구통계학적 변인 중 가·피해자 성별에 유의한 비율 차이를 보였고, 범죄통계학적 요인 중 스토킹기간, 범죄인정 여부에 유의한 차이를 보였다. 스토킹범죄 특성에서는 미행, 감시, SNS정보수집, 가스라이팅, 자·타해위협, 신체적 폭행, 스토킹 지속성, 스토킹 점진적 심각성, 경찰출동에서 유의한 평균차이를 나타냈다. 가해자 위험요인에서는 병적집착 및 의심, 반사회적 생활양식, 일반적 사고가 통계적으로 유의한 평균의 차이를 보였고, 이는 재범집단의 평균이 더 높은 것으로 나타났다. 로지스틱 회귀분석결과 감시와 SNS정보수집이 재범을 유의미하게 예측하는 요인으로 확인되었다. 이러한 결과를 바탕으로 스토킹 재범방지를 위한 법적·제도적 개선방안과 실무적 시사점을 제시하였다.

영문 초록

This study analyzed the recidivism characteristics and risk factors of stalking temporary restraining order violators and proposed preventive intervention strategies. First-instance court judgments related to stalking crimes were examined, coding demographic characteristics, crime-specific factors, and types of stalking behavior. The analysis identified significant differences between recidivist and non-recidivist groups in perpetrator and victim gender ratios, stalking duration, and acknowledgment of guilt. Recidivists demonstrated higher frequencies of behaviors such as surveillance, following, gathering personal information via social media, gaslighting, self-harm threats, physical assault, and the progressive escalation of stalking severity, as well as more frequent police interventions. Logistic regression revealed that surveillance and gathering personal information via social media were significant predictors of recidivism. Based on these findings, the study proposes legal and institutional reforms alongside practical measures to effectively prevent stalking recidivism.
