국문 초록

다문화 학생의 지속적인 증가 예측은 향후 다문화교육 관련 법령들이 활발히 제·개정될 수 있는 사회적 환경에 놓여 있음을 시사한다. 따라서 우리나라가 다인종·다문화 국가로 진입한 현 시점에서 다문화교육 관련 법제가 이러한 환경에 법적 뒷받침이 될 수 있는지 또, 그러한 방향으로 시의성 있는 제·개정이 이루어지고 있는지에 대한 검토가 필요한 시점이라고 볼 수 있으며, 이 점이 본 연구가 가지는 의의라고 할 수 있다. 이에 본 연구에서는 다문화교육 관련 법 현황 조사를 통해 제·개정 동향을 분석하였다. 그 결과 다문화 학생의 실질적인 교육권 실현을 위한 제도 마련에 활동적인 노력이 있어 왔음을 확인할 수 있었으나, 시기별로 향후 다문화 학생의 증가 추이가 예측됨에도 법규가 그 증가 속도에 선제적으로 대응하지 못했음을 확인하였다. 우리나라가 다인종·다문화 국가로 진입하였다는 것은 앞으로도 새로운 교육적 환경이 지속적으로 요구될 것임이 분명하다. 따라서 다문화 교육 관련 법제 연구에 본 연구가 그 기초자료가 되어 관련 연구들이 축적될 수 있기를 기대해 본다.

영문 초록

The prediction of a continuous increase in multicultural students suggests that laws related to multicultural education are in a social environment that can be actively enacted and revised in the future. Therefore, when Korea enters a multiracial and multicultural country, it is necessary to comprehensively examine whether multicultural education-related legislation can be legally supported in this environment and whether timely enactment or revision is being made in that direction, which is the significance of this study. Therefore, in this study, the current status of laws related to multicultural education was investigated and the trends of enactment and revision were analyzed. As a result, it was confirmed that active efforts have been made to prepare a system for realizing the practical right to education for multicultural students, but it was confirmed that laws and regulations did not preemptively respond to the rate of increase despite the prediction of future growth in multicultural students by period. It is clear that Korea has entered a multiracial and multicultural country that a new educational environment will continue to be required in the future. Therefore, we hope that legal studies related to multicultural education will continue to proceed steadily, and we hope that this study will serve as the basic data so that related studies can be accumulated.
