국문 초록

본 연구의 목적은 미국과 한국의 이주 배경 학생 대상 공용어 교육 법제도를 비교 분석하여 시사점을 도출하는 것이다. 국내 이민자가 급속도로 증가함에 따라 이주 배경 학생에 대한 공교육 강화의 움직임이 가시화되고 있다. 2003년 「초·중등교육법」 개정을 통해 교육법 체계 내 이주 배경 학생에 대한 교육 지원 근거가 마련되었으나, 향후 세부적인 교육 방안 마련이 필요할 것으로 여겨진다. 이에 본 연구에서는 이주 배경 학생 대상 공용어 교육의 의의를 살펴보고, 미국의 이주 배경 학생 대상 교육 법제도의 발전 연혁을 정리한다. 미국의 이주 배경 학생 대상 교육 관련법은 연방법과 주법 모두에서 규율되고 있으므로 이 논문에서도 연방법과 주법에서 그것을 어떻게 구체화하는지 살펴본다. 다음으로는 우리나라의 이주 배경 학생 대상 교육 관련법을 살펴본다. 다만 미국과 우리나라의 법령 체계가 다르고 현재 우리나라가 이주 배경 학생 대상의 공용어 교육에 대해 세부적으로 규정하지 않으므로 미국과의 비교 분석을 위해서 교육 정책으로 제시된 내용 중 일부를 함께 검토한다. 마지막으로는 위 내용을 비교법적으로 검토하여 한국의 교육 법제도 개선에 함의하는 바와 시사점을 제시했다.

영문 초록

The purpose of this study is to compare and analyze the national language education legal systems for students with immigrant backgrounds in the United States and Korea to draw implications. As the number of immigrants in Korea is rapidly increasing, there is a visible movement to strengthen public education for students with immigrant backgrounds. Although the amendment of the “Elementary and Secondary Education Act” in 2003 provided a basis for educational support for students with immigrant backgrounds within the education law system, it is considered necessary to develop detailed educational measures in the future. Therefore, this study examines the meaning of national language education for students with immigrant backgrounds and outlines the development history of the education legal system for students with immigrant backgrounds in the United States. Since the education laws for students with immigrant backgrounds in the United States are governed by both federal and state laws, this study also examines how they are implemented in federal and state laws. Next, the study examines the education-related laws for students with immigrant backgrounds in Korea. However, since the legal systems of the United States and Korea are different, and Korea currently does not specifically regulate national language education for students with immigrant backgrounds, some of the contents presented as education policies are also reviewed for comparison with the United States. Finally, the above content is reviewed from a comparative law perspective to present implications and suggestions for improving Korea's education legal system.
