학교자치 입법정신의 규명과 제도보장 분석

국문 초록

이 연구의 목적은 학교자치가 법률과 정책용어로서 혼용되고 있는 현실에서 그 입법정신을 규명하고, 제도보장의 실제와 한계를 분석하여 나아가 법제상의 과제를 제언하는 것이다. 학교자치에 대한 대표적인 다섯 선입견(학교자치=정책용어, 학교자치≠교육자치, 학교자치=학교운영의 자율성, 모든 학교구성원의 자치, 권리의식>제도보장)을 연구문제로서 제기했고, 이를 논의하기 위한 준거로서 입법정신을 규명하고자 하였다. 학교자치의 입법정신은 단위 학교에서 교육자치를 실현한다는 점에서 교육의 자주성등을 보장한 헌법 제31조 제4항에 연원을 둔다. 지방교육자치법을 통하여 ‘단위학교 교육자치’로서 도입된 학교자치는 교육기본법 제정과 더불어 교육의 자주성등 조항을 통하여 ‘학교운영의 자율성 보장’ 규정에 반영되었다. 최근 학교자치조례를 제정한 7곳에서도 그 취지와 학교운영의 원칙을 통해서도 학교자치의 입법정신을 확인할 수 있다. 입법정신은 제도보장으로 나타나게 되는 바, 초·중·고교의 학교운영위원회는 의사결정 구조와 과정의 민주화를, 자율학교는 국가교육과정의 한계를 극복하기 위한 교육내용의 자율화를 지향한다. 그러나 학운위는 민주적 대표성, 사학의 자율성, 직원 위원의 참여, 기초조직의 미비, 소규모 학교 증가 변수 측면에서 한계를 드러내기도 한다. 결론으로서, 학교자치는 법률용어이면서도 정책용어라는 점, 학교자치의 이념으로서 교육자치라는 점, 고유권한 관점의 학교자치와 재량행위 관점의 학교운영의 자율성 간의 구분의 실익이 있다는 점, 학교자치는 학교공동체를 지향해야 한다는 점, 학교자치 권리의식 및 참여의욕에 비례하는 학교자치 제도보장이어야 함을 밝혔다. 이를 지원하기 위한 입법과제로서 교육기본법상의 교육자치 및 학교자치 기초조직의 법제화를, 정책과제로서 선도학교의 확산 미션을 다하는 자율학교를, 그리고 지속적인 전국 수준의 학교구성원의 권리의식 진단과 이를 반영한 학교자치 법제화로의 대응 등을 제안했다.

영문 초록

The purpose of this study is to clarify the legislative spirit for 'school autonomy' and to analyze the contents and limitations of the institutional security. The background of the study is the reality that the term 'school autonomy' is used interchangeably in laws and policies. There are five misunderstandings about 'school autonomy'. In other words, school autonomy=policy terminology, school autonomy ≠ education autonomy, etc. The legislative spirit of school autonomy is based on §31④ of the Constitution, which guarantees the independence of education. The reason is that school autonomy means realizing educational autonomy in schools. School autonomy is indirectly reflected in the 'guaranteeing autonomy in school management' in §5 of the Fundamental Law of Education(Independence of Education, etc.). Recently, the School Autonomy Ordinance were enacted in seven local government. This Ordinance stipulates the principles of school management but does not define the concept of ‘school autonomy’. Institutional security for school autonomy exists in the Elementary & Secondary Education Act. School management committees guarantee a democratic decision-making structure and process. Autonomous-schools are schools that are recognized for exceptional curriculum, and are leading schools that overcome the limitations of the national curriculum. I pointed out the limitations of institutional security in five ways The conclusion of this paper is as follows. School autonomy is a legal term but also a policy term, educational autonomy is the ideology of school autonomy, school autonomy emphasizes essential authority, aims for the school community, and the Awareness of members' rights determines the level of institutional security. Finally, as a legislative task, the need to directly define educational autonomy under the Fundamental Law of Education, the mission of autonomous-schools to spread to general schools, and tasks to reflect awareness of school members' rights in the law.
