국문 초록

CPTPP 투자접근 자유화 규정은 주로 투자접근 대우 규정, 금지된 행위 요건, 임원의 국적 요건 등을 포함하고 있으며, 유사 자유무역협정과 비교했을 때 CPTPP 투자접근 자유화 규정은 적용 범위가 넓고 내용이 상세하며 기준이 엄격하다는 기본특징을 가지고 있어 높은 수준의 투자접근 자유화 규정에 속하는 것으로 볼 수 있다. 중국이 정식으로 CPTPP 가입을 신청한 것을 감안할 때, 이러한 움직임은 중국의 투자 접근 자유화의 전반적인 수준을 향상시키는 데 도움이 된다. 이는 대외 개방을 확대하고 국내 개혁을 심화하려는 중국의 발전 목표에 부합하고 중국 국내 개혁에 새로운 기회를 제공하지만 동시에 중국이 투자 시장을 더욱 개방하고 네거티브리스트의 내용을 축소하며 투자 분야의 국내 법규를 업그레이드 및 개선해야 하는새로운 과제를 안겨준다. 투자 접근 자유화 분야에서 CPTPP 가입이 중국에 가져온도전에 대처하기 위해 중국은 이에 잘 대응하고, 투자 분야 국내 규정과 외국인 투자 네거티브 리스트를 개선하며, 외국인 투자 안전 심사 시스템의 투명성과 법적 확실성을 높이고, CPTPP 회원국의 네거티브 리스트를 참고해 과학적으로 외국인 투자접근 네거티브 리스트를 제정해 각 산업과 분야의 구체적인 행위와 활동을 더욱 세분화하는 동시에 FTZ의 무역 역외 지역을 더욱 발전시켜야 한다. 동시에 FTZ에서높은 수준의 개방 시범 프로젝트를 추가로 실시하고, 투자 접근 자유화 분야에서CPTPP의 높은 수준의 규정을 FTZ 관련 규칙에 완전히 통합하며, 네거티브 리스트의 적용 범위를 시범적으로 간접 투자로 확대하고, 투자 접근 자유화 분야에서 국제협력을 강화하고, 다른 국가와의 심층 협력을 적극적으로 추진하여 중국의 CPTPP 가입에 대한 저항을 최소화 해야 한다.

영문 초록

CPTPP Investment Access Liberalization Provisions mainly consist of the provisions of investment access treatment, the prohibition of performance requirements and the nationality requirements of senior managers. Compared with other FTAs, CPTPP can be called “comprehensive and progressive” high-standard investment access liberalization rules. The provisions feature wide application scope, detailed content and strict standards. Considering that China has formally applied to join the CPTPP, which will contribute to improving the overall level of investment access liberalization in China. These provisions are consistent with China's development goals of expanding the degree of opening up and deepening domestic reform and also provide new opportunities for China's domestic reform. But at the same time, it also brings new challenges for China to further open up the investment market, shorten the content of the negative list and upgrade the relevant domestic laws and regulations in the field of investment access liberalization. In order to meet the challenges brought by China's accession to the CPTPP, China shall make appropriate responses. First, improving domestic regulations and foreign investment negative list in the field of investment by increasing the transparency and legal certainty of the foreign investment security review system and drawing up the negative list for foreign investment access through referring to the negative lists of CPTPP members and subdividing the specific behaviours and activities of different industries and fields. Second, carrying out the pilot of high-standard opening up in the FTZs further by fully incorporating the high-standard provisions in the field of CPTPP investment access liberalization into the relevant rules of the FTZs and extending the scope of application of the negative list to indirect investment. Third, strengthening international cooperation in the field of investment access liberalization and actively promoting deeper cooperation with other countries. All those responses may minimize the resistance of China’s joining the CPTPP. CPTPP投资准入自由化条款主要包括投资准入待遇条款、禁止业绩要求条款和高管 人员国籍要求条款，和同类型的自由贸易协定相比较，CPTPP投资准入自由化条款呈 现出适用范围广、规则内容全、开放要求严的基本特征，属于新一代高标准的投资准 入自由化规则。鉴于中国已经正式提出申请加入CPTPP，此举有利于从整体上提升我 国的投资准入自由化水平，该条款与我国扩大对外开放程度并深化国内改革的发展目 标相契合，为中国国内改革提供新的机遇，但同时也给中国带来了进一步开放投资市 场、缩短负面清单内容和国内投资领域法律法规配套升级完善的新挑战。为应对加入 CPTPP在投资准入自由化领域给中国带来的挑战，中国应该做好相关应对，完善投资 领域的国内法规和外商投资负面清单，增加外商投资安全审查制度的透明度和法律确 定性，参考CPTPP成员负面清单进一步细分不同行业领域的具体行为和活动科学制定 外商投资准入负面清单，同时进一步开展自贸区高标准开放试点，将CPTPP投资准入 自由化领域的高标准条款完全纳入自贸区相关规则中，试点将负面清单的适用范围扩 展至适用于间接投资，此外加强投资准入自由化领域的国际合作，积极推动与其他国 家更深层次的合作，以尽量减少我国加入CPTPP的阻力。
